Shirley Indenture: Wm & Mary Nelson to David Badger : Montgomery County KY Date: 15 April 1807 Deed Book 4 Page 306 This Indenture mad this fifteenth day of April in the year of our lord one Thousand eight hundred and seven between William Nelson and Mary his wife of the county of Montgomery and commonwealth of Kentucky of the one part and David badger of the County and Commonwealth aforesaid of the other part witnesseth that the said William Nelson and Mary his wife for and in consideration of the sum of two hundred and sixteen dollars and sixty six cents lawfull money of the united states to them in hand paid the receipt whereof they do hereby acknowledge and forever acquit And discharge the said David Badger his heirs executors and administrators hath granted bargained and sold aliend and confirmed and by these presents doth grant bargain sell alien and confirm unto the said David Badger his heirs and assigns forever all that tract or parcel of land situate lying and being in the County of Montgomery aforesaid and on the waters of Grassy lick creek it being part of Thorton Farrows preemption containing fifty acres of land and is bounded as followeth Viz Beginning at a buckeye and hickory and running thence North thirty four degrees east eighty poles to a buckeye and box elder on the original line of Thornton Farrows preemption thence North fifty six degrees west twenty two poles to two sugar trees hickory and elm thence west eighty seven poles to a sugar tree & white oak thence South thirty two degrees West eighty six poles to two honey locust trees elm thence South eighty six and a half degrees east one hundred and six poles to the Beginning Together with all improvements water courses profits and appurtenances whatsoeverto the said premises belonging or in any wise appertaining and the reversions remainders and profits thereof and all the estate right property claim and ???? and of them the said William Nelson and Mary his wif of in and to the same to have and to hold the land hereby conveyed with all and singular the premises and every part and parcel thereof with every of the appurtenances unto the said David Badger his heirs and assigns forever to the only proper use and behoof of him the said David Badger his heirs and assigns forever and the said William Nelson and Mary his wife for themselves their heirs executors administrators doth covenant promise and agree with said David Badger his heirs and assigns by these presents that the (Note: At this point, I don't know if there is a line missing or not. However, the following still makes sense without such) premises before mentioned now and forever hereafter shall remain free of and from all former and other gifts grants bargains sales dower right and title of dower Judgements executions Titles troubles charges and incubrances whatsoever done on ????? to be done by them the said William Nelson and mary his wife And the said William Nelson and Mary his wife for themselves and their heirs and all and singular the premises herby bargained and sold with every of the appurtenances unto the said David Badger and his heirs and assigns against them the said William Nelson and Mary his wife and all and every other person or persons rightfully claming any right or title thereto under them the said William and Mary his wife or their heirs doth and will warrant and forever defend provided said lands should be lost then the said William Nelson or his heirs is to refund the said sum of two hundred and sixteen dollars and Sixty six cents with lawfull Interest from the date In witness whereof the said William Nelson and Mary his wife hath hereunto set their hands seals this day and year first above written Signed sealed and delivered Wm Nelson (Seal) In the presence of Benjm I Taul Abel Pickrell Wm Sanders Montgomery County clerks office October the Sixteenth 1807 This deed from William Nelson to David Badger was acknowledged by said Nelson to be his hand and seal act & deed & is duly Recorded in my office Teste M Harrison C.M.C.
