Shirley Indenture of Partition: Ann and Wm Nelson Mrs to Sibby Judy: Montgomery County KY Date: 27 June 1870 Deed Book 48 Page 67, 68 This Indenture of Partition made and entered into this 27 day of June 1870 by and between Polly Priest, Nancy Priest, Caroline Scobee, Elizabeth Hall, Emma Dualey, J Frank Nelson, Susanah Franks, Harriett Wolverton, Columbus Wolverton, Mary Wolverton, Wm Wolverton, Charles Wolverton, Jas B Wolverton, Emma Wolverton, James H Davis, Wm Davis, Sally Holly, Mary McCormick, Eliza Allan, Margaret Mason and John H Mason by and through their Commissioner C Brock: party of the first part and Sibby F Judy party of the second part. Witnesseth: That whereas under a proceeding in the Montgomery Circuit Court in the cause therein pending of George Priest & others against Henry Judy & others there was an order for a division and allotment of the Dower land of Ann Nelson decd widow of William Nelson Decd to and among the aforesaid parties, and whereas said land in pursuance of said order has been divided and allotted to and among their Heirs and devisees of said Ann ^ and Wm^ Nelson, Decd according to their rights therein under a judgement of said Court, and whereas said division and allotment has been approved and whereas the said Sibby F Judy was adjudged 299/3375 of the whole of said land, according to quantity, quality-and value, and whereas the interest of said Sibby F Judy was last off and allotted to her, and whereas by an order of the Montgomery Circuit Court made at its June Term 1870 in Said Cause aforesaid, the Said C Brock was appointed a Commissioner to make and execute Deeds of Partition to and owing Said Nelson and devisees. Now therefore the parties of the first part by and through their said Commissioner and Ward for them, and Said commissioner for and in Consideration of the aforesaid premises, and by Virtue of the Power and authority in him vested by said order of appointment, have granted, Bargained, sold and conveyed and does by this Indenture grant, bargain sell and convey unto the said Sibby F Judy: a Certain lot or parcel of land lying in the County of Montgomery and State of Ky on Grassy Lick Creek and Known on the ?Farms copert? Of division of said Dower land as Lot No 1 and was assigned by them to the said Sibby F Judy and is bounded as follows: Beginning at a set stone Corner with lot No 2,3, and part of 4, or John H Mason and wife, Thence N 1 E 50 6/10 poles to a stone corner with John H Mason. Thence N 85 ½ W 29 poles to a stake in Grassy Lick Creek Corner with William Hofer(there is a line over the o), Thence S 36 W 38 4/10 poles to a stone Corner with Said Hofer (there is a line over the o),. Thence S 16 ½ W 14 6/10 poles to on south Side of a Hackberry, Corner with Same. Thence S 40 W 3 2/10 poles to a stone Corner with Lots Nos. 2, 3, and 4. or John H Mason and wife. Thence S 55 E 57 1/10 poles to the beginning. Containing Fourteen acres of land. The aforesaid lot or parcel of land is hereby, sold and Conveyed by the parties of the first part by and through Said Comr C Brock and Said Comr for them unto the Said Sibby F Judy to have and to hold the Same forever against the claim or claims of any every and all of the parties of the first part-& all persons, claiming, by, through, or under them and Said Comr will warrant the title to Said lot of lands so far as he has power to do the Same, but is in-no wise, nor in any event to be held responsible, in his individual capacity, for this conveyance or any part there of In Testimony Whereof: the Said Comr has hereunto set his name, the day and date first above written.
