Shirley Indenture: William Nelson Sr to William Nelson Jr : Montgomery County KY Date: 7 June 1819 Deed Book 9 Page 136 This Indenture made this Seventh Day of June in the year of our Lord one thousand Eight hundred and nineteen between William Nelson and Polly his wife of the County of Montgomery and Commonwealth of Kentucky of the one part and William Nelson junr of the County and Commonwealth aforesaid of the other part Witnesseth that the said William Nelson and Polly his wife for and in consideration of the sum of one thousand Eight hundred & forty five Dollars lawful money of the: United States of America to them in hand paid the receipt Whereof is hereby acknowledged hath granted bargained and sold to the said William Nelson jnr a certain parcel of land lying in the said County of Montgomery on Grassylick creek containing ninety two acres and one quarter of land a part thereof was originally pattented to John Payne and another part to William Jenkins and a part is held under the claim of William Farrow heir at law of Thorton Farrow and is bounded as followeth (towit, Beginning at two hickories and white oak at the intersection of Dulings and Farrows lines and extending thence North twenty Eight Degrees East thirty Eight poles to a sycamore and sugartree on the North side of the west fork of Grassylick creek thence Down the creek East forty five poles thence North Seventy five and a half degrees East forty poles to a stone in the forks of the creek thence Down the creek North thirty seven Degrees West twenty six poles thence twenty two and a half Degrees East thirty three poles thence North twenty three and a half Degrees West twenty four poles thence North sixty nine Degrees West twenty Eight poles to a hickory white oak and Buckeye on the bank of Grassylick creek thence south Seventy Eight Degrees West one hundred and thirty three poles to a stake in Thaddius Dulins line thence South twenty two Degrees East one hundred and and twenty poles to the Beginning with all its appurtinences to have and to Hold the said parcel of land with the appurtinences unto the said William Nelson Junr and his heirs to the only proper use and behoof of him the said William Nelson Junr and his heirs forever and the Said William Nelson Sen and Polly his wife the said parcel of land with the appurtinences to the said William Nelson Junr and his heirs or assigns against the claim of all persons whatsoever claiming any rights or title thereto under them the said William Nelson Senr and Polly his wife or their heirs Doth and will warrant and forever Defend But not against any other person or persons for the said William Nelson Senr and Polly his wife sells and the said William Nelson Junr buys only the title of the said William Nelson Senr and Polly his wife as his the said William Nelson Junior own risk and the said William Nelson Sen and Polly his wife to be no way liable or accountable either for purchase money Interest certs or Damages provided the said land or any part thereof should be lost The said William Nelson Junr may however prosecute any such at law or other remedy against William Farrow who has warranted the said land to the said William Nelson Sen either in his own name or in the name of the said William Nelson Junr provided said land should be lost/ that the said Wm Nelson might or could Do or the law will authorise for the recovery of so much as the said Farrow is bound to pay to the said William Nelson Sen provided said Land or any part thereof should be lost In Witness whereof the said William Nelson and Polly his wife hath herunto set their hands and affixed their seals this Day and year first above written Signed sealed and Delivered in Wm Nelson (Seal) Presence of Polly X Nelson her mark
