...of land aforesaid unto the said James Hays his heirs or assigns forever against all persons whatsoever claiming by through or under him and provided the land is lost or taken away by any other prior or better claim then and in that case the aforesaid Ragland doth by these presents covenant and agree to pay and refund unto the said James hays his heirs or assigns the purchase money aforesaid without Interest in testimony whereof he has hereunto set his hand and seal the day and and (sic) date above written
