WILL OF DAVID ENGLAND OF MONTGOMERY, KENTUCKY
written 19 August 1801, proved 8 December 1801

In the name of God Amen I David England of the County of Montgomery being very sick and 
weak, but of perfect mind and memory, thanks be given unto God , calling into mind the 
mortality of my body, and knowing that it is appointed for all men once to die, do make and 
ordain this my last will and testament. That is to say principally and first of all I give 
and recommend my soul into the hand of Almighty God that give it, and my body I recommend
to the earth to be buried in decent Christian burial at the discretion of my executors 
nothing doubting but at the general resurrection. I shall receive the same by the almighty 
power of God.  And as touching such worldly estate wherewith it hath pleased God to bless me 
in this life. I give, desire, and dispose of the same in the following manner & form.

First, I give and bequeath to Lucy my dearly beloved wife all my cattle, hogs, and horses, 
carpenters & farming tools, together with all my household furniture and fifty acres of land 
to include the plantation where I live, that is to say to live on for her life time. At her 
death, the said fifty acres of land to be divided equally between my three youngest
daughters when they become of age, namely Deborah, Lucy, and Elizabeth. Also, I give to my 
well beloved daughters Nancy, Polly, and Eleinder each one cow out of the above mentioned 
stoll of battle. Also, I bequeath to my three sons, Stephen, Jesse and David five
hundred acres of land on (?). Also, I appoint my wife Lucy and my son Stephen my
executors of this my last will and testament. And I do hereby utterly disallow, revoke, and 
disannul all and every other former testaments, wills, and legacies, bequests, and executors 
left me in anywise before noted willed or bequeathed.

Notifying and confirming this and no other to be my last will and testament. In witness 
whereof I have hereto set my hand & seal this nineteenth day of August in the year of our 
Lord one thousand eight hundred and one.

Signed, sealed, published, pronounced, and declared by the said David England as his last 
will and testament in the presence of us, who in his presence and in the (presence) of each 
other have hereunto subscribed our names.

(Added note) I leave to my daughter, Sarah Bailey seventy five cents together with what she 
has already received.

Montgomery County Court - December Court 8th 1801

This last will and testament of David England deceased was produced into court by Stephen 
England & Lucy England, executors herein named and proved by the oaths of Thomas Lewis and 
Valentine Stone, witnesses thereto subscribed and ordered to be recorded. The executors made 
oaths as the law directs, gave bond & security, and certificate of probate thereof was
granted them in due form of law.
