Shirley Wills: Jonathan Hathaway: Montgomery County KY Date: 1827-29 Will Book D Page 63,64 In the year of our Lord eighteen hundred and twenty seven, In the name of God amen I, Jonathan Hathaway of the state of Kentucky & County of Montgomery being sick & weak in body but of perfect mind & @ & @: (Thanks be to god for Calling to my mind the mortality of my body, and making me know that It is appointed for all men to die!, do make this the following my last will and Testament & principally and first of all I give and Recommend my soul to the almighty God who gave it to me and my body I recommend to the grave to be buried in a decent manner at the discretion of my family and Executors-not dubting as my sole came from god but what it again return to him-and as touching upon such worldy estate with which it has pleased God to bless me I give and dispose of in the following manner and form: First to divide my land beginning in the big road at Roger Clements North west corner (now claimed by Philip Hathaway senr) thence with the said line to his corner thence with Groves (possibly Graves) line east to James Hughes,s line thence west with Hughs line to blue Grass lot the north west corner of the same that James Raffidy cleaned, thence South west opposite the South west corner of the apple orchard thence with a straight line to the Beginning: thence with a straight this lot of Land I give to my wife Catharine her life time, and at her death cease to my son Allen- Now to Continue the line South opposite: the Corner of the apple orchard to James Allens line all the Land that I hold west of the said line I give to my son Miller and all the Land that I hold west east of it to my son Allen & profits arrizeing therefrom. This land which I have name to them is and shown be my wife Miller & Allen together with what other property I Shall hereafter name to them is and shall be in full of all their parts in my estate forever and also of all that may here after advert to it, September 1828, I do further will, & Give to my wife Catharine Hathaway her life time seven Negroes, namely, Rose, Hannah, Mary & Milly and her three children (if Rose proves unruly she must be sold and the money divided among the children that I shall direct other moneys arising from property which shall be sold/ I also give unto her three horses namely Ned, Jane and Rosann four Cows & one third of my sheep; my large Steers, one third of my farming utensils; the house & Kitchen furniture, except what shall be named to others; one third of half of my stock of hogs, and one third of Gregs of service for four years. I will here mention that Gregg is to serve four years & then be set gree provided he can give good security for good behaviour for the future.-I give unto my son Miller two Negroes namely Squire & a boy now living with old Phillis: one Grey horse one sorrel mare, one sorrel horse called Liberty & a colt; a saddle & Bridle, two colts Cows & Calves, one third of my sheep, one third of my farming utensils; my red oxen & desk; and one third of half of my stock hogs now on hand: I give to my son Allen ???? Allen two Negroes namely Ben & George; two cows & claves, one third of my sheep; one third of my farming utensils; a yoke steers of his own choosing; my clock; three mares namely, one sorrel mare called "Taly" one called Snap & one bay mare a saddle & bridle & one third of half of my stock of hogs now on hand. I give unto Matilda Hathaway who now lives with me fify dollars; I give to my daughter Louisiana three negroes namely Margaret ?Oipanin? and Maranda; a sorrel horse Called Jim, one Bed & Bedding saddle & Bridle & @-- February the 28th 1829, I further willeth & give to Emma my daughter all that portion of my mount dismal tract of Land which lies on the south side of the road, amounting to Ninety nine acres & some poles at six dollars per acre, except a lot, which is fenced in, and she is to have of my estate. I give to my daughter Louisiana five hundred dollars in money which is to be paid to her out of the first money that is collected from the sales of money property, I will here mention that on the twenty fourth day of this month, I received from my son in Law- G B Rogers his receipt for the exception of a part of the property before named to my daughter Louisianna, now his life wife; namely three Negroes, Margaret, Cipann and Maranda, bed & beding & saddle & Bridles, together with a ?Isrey? horse Called Peter, all estimates at one thousand dollars. It is my will that what property I have given to my sons & daughters shall belong to them and their wives & husbands ( rest of line unreadable) next page starts: which may have been received by the deceased been regularly receipted for shall belong to the husband & wife as the case may be forever, and it is under such circumstances, to be all that their heirs shall have of my estate or property which may hereafter advert to it, as Respects my son in Law James Johnston & his daughter Elizabeth they are to have what property my daughter Elizabeth, has received and regularly receipted for before her decease, & nomore of it or which may ever come to it. I appoint General Samuel L William my son Phillip & son in law G B Rogers my lawful executors & Administrators at my decease and whatever disposition &c. which they make of my estate as above discribed & which, shall also below bedone, shall stand good in law they are to deliver my children all property which beforee & shall hereafter be named to them, if not done by me before my decease, and make deeds titles rights &c &c and to sell all my property which shall not have been given away before my decease, or dispose of it otherwise as they may deem most advisable and beneficial & profitable to my children to whom it is to be paid. After paying to my daughter Louisianna five hundred dollars out of moneys arrizing from the Sales of my disposable property and collecting all sums due to my estate & paying all my just Debts, the balance of the money is to be equally divided between Polly Masterson Phillip Hathaway and Louisianna (my children,- March 25th, I further willed that the grain on hand is to be used in feeding the stock given to my wife Miller, and Allen and also for feeding the stock which is to be disposed of untill disposed of Gill is to be ree whenever he gives good security for a Continuance of good behaviour for the future- I give to mysons Miller & Allen the rifles now in their possession and my old rifle to my son in Law G B Rogers- Frank & Cyrus is to be sold and the money arrizeing from the sale to be managed as before directed for all dis- (line unreadable) Next page continues: Me to live a while longer and I should make up a little ??se of money by the use of property not actually given away it is to be Considered distinct from my other property, and is to be disposed of as I may hereafter deem proper Signed sealed & given under my hand this 25th day of May eighteen hundred & twenty nine, in the presence of John R Groves Jonathan Hathaway (seal) James H Groves State of Kentucky Montgomery County } sct July Court 1829 This last will and testament of Jonathan Hathaway Decd this day proved by the oaths of John W Groves & James H Groves witnesses thereto subscribed & ordered to be Recorded which is done Att: M Harrison Clk Please note that the name Groves could easily be Grover. srm
