I Peter Honaker of Montgomery County Kentucky being in a declining State of Body but of perfect mind and memory and Calling to Remembrance that it is appointed all men to die do m ake and ordain this my last will & Testament and first I commit my body to the Dust from whence it Came & my Soul into the hands of God that gave it In modest Hope that this the _____ the _____ or I shall receive them both again at the Resurrection of the Just and as for Such worldly Estate as it has pleased God to bless me with I give and dispose of the same in the manner following Viz First I Give and bequeath to Mary my wife faithfull and well beloved wife the possession and enjoyment of all my estate real and personal during life or widdow and in Case of her marriage I desire that all my stock and movable property of every description (except such as herein or otherwise disposed of) be sold and the money Equally divided among my Children Viz Molly Ellen John Martin William & Charles Wesley (note from Ann-there are no comma's between the names but they are all seperate people but Charles Wesley who is one person) as they Severally arrive at age according to Law. Secondly My desire is that my Negroe Wench Liz live with and Serve my wife during the life of my wife and Case of the death of my wife Liz shall not be sold nor Considered as property to be disposed of but the said Liz Shall have free liberty to choose which of my Children She will live with and She the Said Liz shall live with and Serve that one and none other during her life and if the Said Negro wench have any Children they shall not be separated from her but shall live with her until they shall be judged fit for Service by my Executors and then they Shall be hired out until they arrive at the age of twenty five years and the hire shall be divided among my Children as they arrive at the age according to law and when Said Negroe Children Shall arrive at the age of twenty five years I do hereby liberate and manumit and discharge said Negro children from any Longer Service and declare that they shall thereafter be free to all intents & purposes as though I myself had lived to Execute an instrument of Emancipation and I do hereby Solemnly require and Charge my Children and Executors not to keep the said negro Children in bondage any longer than the bove named time and I do further charge my Executors to be particular in the Execution of this part of my last will and testament. Thirdly In Case of the death of my wife before my sons arrive at age I desire that my sons may be put to good ___ discretion of the Surviving Executors and I desire in such case that my land be rented out and the money put to interest until my youngest Child arrive at age and I desire that my land may be sold on such credit as may be judged best by my Executors and the rent money and money arising from the Sale of my land be divided as it be comes due equally among my Children. Fourthly and Lastly I do hereby nominate appoint and Constitute my true and beloved wife Mary Honaker to be my Executor and my trusty friends Chrles Holliday and John Evins to be my joint Executors with my wife of this my last will and Testament and declming all former wills & testaments or Executors do acknowledge and avow and declare this only to be my last will and testament and the above named persons to be my only proved and lawful Executors In testament where I have hereunto Set my hand this Twelfth day of august anno domine eighteen hundred and eight. Peter Honaker seal Signed and ack Montgomery nowledged by the County November above Peter Honaker Court 1808 to be his last will The last will and testament and testament in the presence of Peter Honaker of us who in his has been presented into presence and court by Mary Honaker in the presence Executrix and of each other and John Evans Executor have hereunto who made oath SIgned our names thereto according John Thompson to law and the George Ball & Same being proved Robert Moore by the oaths of John -------------- Thompson and George Ball witnesses thereto Subscribed and ordered to be recorded and on the motion of Said Executor and Executrix who entered into bond and acknowledged bond with John Thompson, George Ball their Securities in the penalty of six hundred dollars Conditioned as the Price directs a Certificate is granted them to obtain a probate thereof in due form Liberty being reserved as to the other Executor named in Said will to join in probate when he shall think of it. teste M. Harrison clerk Additional Comments: The Honaker Family Assocition placed a bronze Revolutionary War memorial in the Bailey Cemetery of Bath Co., KY (GPS co-ordinates are Latitude 38.1833 Longitude -83.7828) (his actual place of burial is unknown at this time) which reads,"Peter Honaker son of Hans Jacob Honaker and husband of Mary Musick was a revolutionary war soldier who served with his brothes Henry & Frederick in the Battalion with George Rogers Clark in the 1778 mission to the Northwest Territory" The marker was placed on Sept 8, 2001. Peter Honaker left behind six children under the age of 14.
