Shirley Wills: William Nelson (Jr): Montgomery County KY Date: 16 December 1857 Will Book F Page 45, 46 In the Name of God! I William Nelson of the county of Montgomery and state of Kentucky being weak in body but of sound mind, and being desirous to dispose of such property as I am blessed with, do hereby make this my last will and Testament as follows: To wit: 1st After my death, my will is that all of my just debts be paid. 2nd I will to my dear wife Ann nelson one third part of my estate during her natural life, or while she remains a widow, and at her death I want it to return back to all my children equally, she reserving to herself all the property of her own, that decended (sic)to her from the estate of her first husband William Davis deceased. 3rd After taking out one third of my estate both real and personal, as above directed for the dowery of my wife Ann, the remainder to be divided between all my children. I having heretofore made advances to the following named children. Twenty one hundred and fifty each to Elizabeth hall, wife of James Hall. Ann Wolberton late wife of Washington Wolberton, Polly Priest, wife of Geo W Priest. Caroline Scoby, wife of Robert Scoby, Nancy Priest wife of David Priest, James Franklin Nelson, John B Nelson and Susan Dooley, wife of Milton Dooley. The above named heirs each having had the said sum of twenty one hundred & fifty dollars in my estimation advanced to them. My will is that my following named children be made equal with them, by receiving Twenty one hundred and fifty dollars: That is, Sibby Frances Nelson, Emmy T Nelson, Surilda T Nelson, Margaret Jane Nelson & Telitha Cuma Nelson, after my five last named children has received twenty one hundred and fifty dollars each, the remainder of my estate both real and personal, to be equally divided between all my children that is living. Ann Woberton (sic) being dead my will is that all of such said Ann Wolberton's children have her part that she would be entitled if she was alive, equally divided between them. 4th and Lastly I do hereby constitute and appoint my two sons Jas Franklin Nelson and John B Nelson my executors to carry out this my last will and Testament, without giving security as executors, I having the utmost confidence in them. In Testimony whereof I have hereunto set my hand and seal this the 16th day of December 1857 Attest William X Nelson M Halley his mark John A Thomson Fredrick Williams State of Kentucky Montgomery County Court} January special Term 1858 A writing purporting to be the last will & Testament of William Nelson deceased was this day produced in court, and proven to be the Last will and Testament of the said William nelson deceased by the oaths of John A Thomson and Fredrick Williams subscribing witnesses thereto, who, also, proved the attestation of M Halley another subscribing witness to said Will, which will was examined and approved by the court and ordered to be recorded which is accordingly done.
