I therefore devise my Estate with which it has pleased Divine Providence to bless me in the following manner, aiming and desiring to do equal Justice between all my family. To wit. Item 1st. I give and devise to my youngest son William *. Shutt the tract of land on which I reside, containing about two hundred and twenty five acres. It being the same that belonged to my Father. And twenty five acres to be laid off adjoining the above tract, all of the land I purchased of Roach. And also fifty acres adjoining Said first named tract, surveyed and taken up by me. Item 2d. I give and devise to my son Thomas Shutt the balance of the tract of land not given and conveyed to my son Jacob M. Shutt, on which said Jacob M. Shutt now resides. The Residue containing about one hundred and forty four acres. And also I give to my said Thomas a one hundred acre tract of land it being the same I purchased of Allen. Item 3d. I give and devise to my Two Daughters Elizabeth Dame(?) and Amanda A.(or S.?) Kittinger jointly as the heirs of each to Represent the Parent, my interest. It being one fourth in a tract of one hundred acres of land descended to me from my Father's Estate. Item 4th. I give and devise to my Wife Eleanor one half of the farm tract of land devised to William in the 1st Item to be laid off to include the House and Orchard and my Slave Jarret. To hold and use during her lifetime or widowhood. And also after the payment of my debts as much of the personal property as she pleases to hold during that time. At her death I desire the said Slave to be Sold to the highest bidder among my children but not to be Sold out of the family. Item 5th. I desire and will that the Residue of my Estate be divided among my children equally if living. If not, that the child or children of the decedent draw the part of the deceased parent. In Witness whereof I publish this as my last Will and Testament and Set my hand and Seal hereto. the 30th day of April 1846. Jacob Shutt -Seal In presence of Elisha Baker Dillis Dyer Whereas my wife Eleanor has departed this life, My Will is by way of addition or codicil to the foregoing my last Will and Testament that at my death my Slave Jarret whom I value at $600 and he to have choice of either of my children as a Master or Mistress. and that one which he may choose is to have him by the payment of the $600 into the Estate. But if no one of them will take him at that price then he is to be Sold to the highest bidder among my children.
