All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ky/kyfiles.html ************************************************ File contributed for use in USGenWeb Archives by: Larry Barnes lbarnesgensearch@yahoo.com May 20, 2009, 1:25 pm Source: Will Book 4, Pages 349-350 Written: September 25, 1843 In the name of God Amen, I Elijah Barnes of the County of Nelson and State of Ky, being old and infirm but of Sound mind and disposing memory (for which I thank God) and calling to mind the uncertainty of human life and being desirous to dispose of all such worldly estate as it has pleased God to bless me with do give and bequeath the same in manner and form following Item 1st I give and bequeath to my son Gideon Barnes in trust for my daughter, Nancy Brown, and her children lawfully to be begotten of her body one negro girl named Malinda which she now has possession of. Item 2nd I give and bequeath to my son Gideon Barnes in trust for my son William and his children one negro boy named Reuben which he now has possession of. Item 3rd I give and bequeath to my son Gideon Barnes in trust for my son James his wife and children the tract of land on which he now lives on Middle Creek in Larue County. Item 4th I give and bequeath to my son Gideon Barnes a girl named Mary which he now has possession of. Item 5th I give and bequeath to my son Gideon Barnes in trust for my son Armstead his wife and children a negro boy named Lewis which he now has possession of. Item 6th I give and bequeath to my son Gideon Barnes in trust for my daughter Eliza and her children lawfully begotten of her body one negro girl named Rebecca which she now has possession of. Item 7th at my death I will all my estate of every kind & character (after the payment of my Just debts) to be equally divided among my children named above except that my Grandson Edwin F. Barnes is to have a half share of my estate which I shall have at my death undisposed of. And lastly I do hereby Constitute and appoint my son Gideon Barnes Executor of this my last will and testament hereby revoking all other or former wills or testament by me made. In witness whereof I have hereto set my hand and affix my seal this 25th day of September 1843. Elijah Barnes Signed and sealed published & declared as and for the last will and testament of the above named Elijah Barnes in presence of us Teste Phil. C. Slaughter Teste Peter Abell At a court held for Nelson County at the Courthouse on Monday the 10 day of March 1845, This last will and testament of Elijah Barnes dec'd is produced in Court proven by the oaths of Phil. C. Slaughter and Peter Abell two of the subscribing witnesses thereto to be the last will and testament of Elijah Barnes, whereupon said will is ordered to be recorded and on the motion of Gideon Barnes the Executor named in said will the execution of said is allotted to him he having entered into and acknowleged bond in the penalty of $6000 with Samuel Barnes, Samuel Ross, Mathew Greenwell, Ignatius Dawson and Mathew Norris his securities, Conditioned according to law.
