Contributed by: Gwen Hurst (gwnj@shentel.net) Date: Thursday, November 26, 1998 ************************************************************************************** Heirs of Andrew Blunt (Blount) deed 1839 This Indenture made and entered into this eighteenth day of September One Thousand eight hundred and thirty nine between Hezekiah Blunt & Ann his wife, Anna Moore late Anna Blunt of the County of Nicholas and State of Ky. and Manley Harden & Polly his wife late Polly Blunt of the County of Bath and State aforesaid and Isaac Prather & Abigail his wife late Abigail Blunt and James Pasley & Elizabeth his wife late Elizabeth Blunt of the County of Hendricks and State of Indiana all Heirs & Legal representatives of Andrew Blunt Dec. party of the first part and Wesley Jewel of the County of Nicholas and State of Kentucky a party of the Second part. Witneseth that the said parties of the first part for and in Consideration of the sum of four hundred & twenty dollars to them in hand paid the receipt of which is hereby acknowledged and the party of the Second part acquitted and discharged the parties of the first part have granted bargained and sold and by these presents do grant bargain sell and convey unto the party of the Second part his heirs and assigns forever their equal and undivided interest in and to a Certain tract of land Containing by survey fifty one acres and fourteen poles which descended to them the parties of the first part by their Father Andrew Blunt Dec. Said tract of land is situate in the County of Nicholas and State Ky. on Hinkson and bounded as follows towit. Beginning at a stone corner to Andrew Mairs in Charles E. Porter’s line then with the same North 89 1/2 W 147 3/10 poles crossing Hinkson to a Beech on its West bank thence North 14 E 43 7/10 poles to a Black Walnut tree in sd. Porters line corner to Hezekiah Blunt then with his line North 87 E 46 4/10 poles to a stone on the West side of a branch corner to said Blunt then with his line North 1 1/2 W 17 2/10 poles to a stone on the west side of said branch Corner to sd. Blunt then with his line North 76 ?/4 E 73 3/10 poles to a stone on Andrew Mairs line then with the same South 20 3/4 E 85 2/10 poles to the Beginning. Together with all and singular the premises and appurtenances thereunto belonging or in any wise appertaining. To have and to hold their the parties of the first part their equal and undivided interest in and to said described tract of land with the appurtenances unto the party of the second part his heirs or assigns forever. And the Said parties of the first part for themselves their heirs executors and administrators do convey their equal and undivided interest in and to Said described tract of land & promises unto the Said party of the Second part his heirs or assigns against the claim or claims or demand of themselves their heirs and all and every other person or persons whatsoever claiming or to claim by through or under them, do and will warrant and forever defend their equal and undivided interests by these presents. But will not warrant or defend against any person or persons whatsoever claiming or to claim adversely to them the parties of the first part. In Witness whereof we the parties of the first part have hereunto set our hands and Seals the day and year first above Written. Hezekiah Blount (seal) Anna Blount (seal) State of Indiana, Hendricks County - Manley his x mark Harden (seal) Personally appeared before me the undersigned one of the Justices of the peace of Said County Mary her x mark Harden (seal) Ann her x mark Moore (seal) Isaac James his x mark Pasley (seal) Prather and James Pasley and Elizabeth her x mark Pasley (seal) acknowledged the Deed of Con- veyance to which this is annexed to be their acts and deed for the purposes therein Isaac Prather (seal) Abigail her x mark Prather (seal) Isaac Prather and Elizabeth Pasley the wife of the said James Pasley being both Separately examined apart from their said husbands and the full contents and purport of the above deed being made known to them they did declare that they did voluntarily and of their own free wills and accords and as their acts and deeds deliver the said deeds and conveyance without any coercion or compulsion from their said husbands. Given under my hand and seal this 3rd day of Oct 1839. State of Indiana Hendricks County I James M. Gregg clerk of the Circuit Court of Said County do Certify that Benjamin M. Logan Esquire who appears to have taken the acknowledgement of Isaac Prather, Abigail Prather, James Pasley and Elizabeth Pasley to the foregoing deed of Conveyance and whose Certificate is above was at the time of taking and Certifying the same, and now is an acting Justice of the Peace in and for the County of Hendricks, duly Commissioned and qualified, and that full faith and credit is due and ought to be given to his official acts and that I believe the above Signature purporting to be his is genuine. In testimony whereof I have hereunto set my hand and affixed the seal of said Court at Danville this 4th day of October 1839. I. M. Gregg Clerk. I James Morrison, President Judge of the fifth Judicial Circuit of the State of Indiana hereby Certify that James M. Gregg, whose attestation appears to the foregoing instrument, was at the time of making the same and now is the Clerk of the Hendricks Circuit Court within Said Judicial Circuit, duly Commissioned and qualified, and that his attestation is in due form of law. Given under my hand at Indianapolis this 6th day of October A. D. 1939. James Morrison. Commonwealth of Kentucky @ Nicholas County, towit I I. G. Nanks, clerk of the County Court for the county aforesaid, do certify, that this deed from Hezekiah Blount & Anna his wife, Manley Harden & Mary his wife, Ann Moore &c. to Wesley Jewel was, on the 18th day of September 1839, acknowledged before me in my office by said Hezekiah Blount, Manley Harden and Ann Moore to be their acts and deed, and the said Anna Blount and Mary Harden being examined by me privly and apart from their husbands, declare that they did freely and willingly by Seal and deliver said writing and wish not to retract it, and acknowledged said writing again shown and explained to them to be their acts and deed and consent that the same may be recorded. Whereupon Said Deed, together with the foregoing Certificates and this Certificate hath on this day been duly admitted to record in said office. Given under my hand this 27th day of April 1840. I. G.
