Between Edward Eshum of the one part and Eliza Eshum and Eunice Eshum of the other part witnesseth. That whereas the said Edward hath purchased from the said Eliza Eshum, her interest in fee simple, in a certain Negro Girl named Milkey, now in possession of said Edward, for the sum of Fifty Dollars to be paid in Twelve months from this date. And is also indebted to the said Eliza in the further sum of Forty-five Dollars for the hire of her Negro man and for a certain cow and calf purchased from the said Eliza making in all the sum of Ninety-five dollars to be paid in Twelve months from the date thereof. And whereas the said Edward is indebted to the said Eunice Eshum in the sum of one hundred dollars for her dower right in a certain Negro named Peter, which the said Edward hath sold. Now this mortgage shall and doth witness that in order to secure to the said Eliza Esham the payment of the said sum of Ninety-five dollars in Twelve months from this date and in order to secure to the said Eunice Eshum the payment of the said sum of one hundred dollars in Twelve months from this date, with interest on the same from this time, the said Edward Eshum hath this day bargained and sold and by these presents, doth bargain sell alien and confirm unto the said Eliza Eshum and the said Eunice Eshum their heirs and assigns all his right and interest in fee simple in and to the Negro girl slave named Milkey, as first above mentioned To have and to hold the same unto them the said Eliza and thesaid Eunice, their heirs and assigns forever. But it is especially agreed that this Sale and Mortgage shall be void upon the payment of the several sums herein before mentioned in twelve months from this date. Otherwise to remain in full force and virtue. And further whereas the said Eunice Eshum holds a life’s estate, in right of her dower, in the said Negro girl Milkey, and hath heretofore permitted the said Edward to enjoy the services of said Girl for the benefit of his family, and is willing that he should have her another year upon condition that he will clothe her well and return her to the said Eunice at the end of the year from this date. Now the said Edward in consideration of the promises further binds himself to clothe the said Negro girl Milkey with good substantial clothing and to return her to the said Eunice in Twelve months from this date. In Testimony whereof the said Edward Eshum hath hereunto set his hand and seal, the day and year first above written. Edward D. Eshom seal State of Kentucky Sct. I J.G. Parks clerk of the Nicholas County Court do certify that this Deed of Mortgage from Edward Eshum to Eliza and Eunice Eshum was on this day produced to me in my office and acknowledged by the said Edward Eshum to be his act and Deed.
