Item 2nd: It is my will that my brother John Foster have my negro man Ben during Said Fosters natural life and at my Brothers death it is my will that said Ben be free. Item 3rd: It is my will that my negro woman named Let be sold in the neighbourhood if possible but she is to be sold anyhow but not to go down the River three hundred dollars of the money ensuing from such Sale is to be used by my brother John Foster to buy my Sister Leanna Gentry a a negro girl or woman for the benefit of her and the hair of her body. Item 4th: It is my will that Permelia Collins is to have a thousand dollars three hundred dollars to be received this fall and the balance out of the Second payment of my land. Item 5th: It is my will that James Foster, son of John Foster Shall have a thousand dollars the first part of it to be the balance of the Second payment of my land the the balance to come out of the third payment. Item 6th: It is my will that Orace Foster, Son of John Foster have a thousand dollars also to be the balance left of the third payment and the rest out of the fourth payment on my land then if there be a balance Thomas Foster Son of John Foster is to have it. Item 7th: It is my will that the balance of my property and money b(?) with Sister Nancy Palmer and brother Henry Foster the negroes that they get are to be free at each of their death and they are not to be Sold for any time from them. All the property left unsold at my death is to be Sold on account of twelve months. My hogs now Sold by John Foster are to be a Canvasse(?) Sale. And I do further direct that inasmuch as my estate is not interchanged and have full confidence in Jesse Kennedy who I do hereby appoint the executor of my last will and testament that no security be require of him for his performances as Such Signed by the Testator this twenty-eighth of August eighteen hundred and thirty and in the presence of us. Brothers: John Foster, Henry Foster Sisters: Leanna Gentry, Nancy Palmer Nephews: Orace Foster, son of John Foster; James Foster, son of John Foster Permelia Collins, possible unmarried consort Thomas, John, and Henry are brothers, John has son James, Orace. Jesse Foster may be related to Thomas above. Note that Jesse Kennedy is Thomas’ Executor and Sam Penn is a witness. Jesse Foster’s daughter Philadelphia married Samuel Kennedy Penn, making Jesse Kennedy a possible cousin or in-law of Samuel Penn. Jesse has 2nd wife Patsy, sons by 1st wife George, Hubble, Asa (m. Mary Pullen), Nathaniel, daughters Philadelphia, Nancy, and Fanny, and by 2nd wife son Wharton and daughter Elizabeth. I believe Jesse may be a cousin, since he is not listed in Thomas’ will as a brother. (Bourbon KY Marriage Bonds 1786 to 1835 states that Jesse Foster married Patsy Jones, witnessed by Wharton Jones. Wharton and Elizabeth were probably Patsy’s children by a former marriage).
