Mitchell all the notes which I paid off for her to McHenry for her land it being the same which she now lives on which is to be and her childrens full portion of the whole of my estate both personal and real. 3rd I wish my son Thomas W. Acton to be charged fifty dollars to come out of his portion of my estate he having received that much of his portion. 4th My wish is if the Government should ever pay anything for my slaves that my daughter Eveline Davis and her husband should not receive any part of it. 5th My wish and desire is that the balance of my estate be equally divided between all of my children except Susanah C. Mitchell who has received her part. 6th I nominate and appoint Noble Bean and my son Fielder W. Acton my executors to settle up my estate and wish the Ohio County Court to recognize them as such. 7th I will and bequeath my soul to God who gave it. In testimony whereof I hereby set my hand and seal this 21st day of March 1867. Bartemus Acton [seal] Signed and sealed in presence of us John W. Miller Thomas H. Moseley Clerk of the County Court for the County and State aforesaid certify that this last will and testament of Bartemus Acton Decd was made on this day produced in Court and duly proven by the oath of Thos H Boswell one of the subscribing witnesses thereto and who also made proof as to the attestation of John W. Miller the other subscribing witness as prescribed by law in such cases. And the same being named and approved by the court was ordered to be recorded which is done together with this certificate.
