DEED: Hodson's heirs to Bates, 1846 - Owen County, KY Deed of Final Sale from John B. Hodson’s Heirs to Bates transcribed from Owen County, Kentucky Deed Book I, page 477-478 This indenture made entered into this 13th day of May 1846 between James Greenwell and Sarah his wife; Joshua S. Hodson; William C. Curry and Nancy his wife; Joseph Rogers and Mary his wife; William H.H. Hodson; Andrew J. Hodson; David Deering and Mahala his wife; Thomas Douthit and Mildred S. his wife; and Almira Hodson, heirs of John B. Hodson, deceased, by their commissioner James W. Bacon of the one part and John C. Bates of the other part witnesseth that whereas by a decree in a certain suit in chancery (?) pending in the Owen Circuit Court at their May term 1845 in which the said John C. Bates is complainant and the parties of the first part are defendants. It was ordered that a certain tract of land more particularly hereinafter described be sold and N.M. Bacon was appointed commissioner to carry said decree into effect and afterwards at the October term of the Owen Circuit Court said N.M. Bacon commissioner as aforesaid made report of his sale of said land which report was received and confirmed by the court and that John C. Bates became the purchaser of said land at the price of one hundred dollars subject to the dower right of Elizabeth Hodson, widow of John B. Hodson, deceased, and whereas at the said May term 1846 the said Jas. W. Bacon was appointed commissioner to convey for and on behalf of said John B. Hodson, deceased, the tract of land in the Bill of this cause mentioned to the said John C. Bates. Now therefore this indenture witnesseth further that the said parties of the first part by their said commissioner in consideration of the premises and the sum of one hundred dollars in hand paid the receipt whereof is hereby acknowledged have granted bargained and sold and by these presents do grant bargain sell and confirm unto the said John C. Bates his heirs and assigns forever all the right title and interest of the parties of the first part in and to that certain tract or parcel of land lying and being in Owen County, Kentucky on the waters of Cedar Creek containing ninety-eight acres one rood and 35 poles or the same more or less subject to the dower right of said Elizabeth Hodson widow of John B. Hodson dec’d and bounded as follows: Beginning at three small hickory saplins standing on the north side of Clarks branch thence north 158 poles to two beeches and sugar tree thence east 185 poles crossing Cedar Creek to three sugar trees thence south 30 poles to two ironwood standing on the bank of Cedar Creek thence down the same south 72 west 94 poles to two sycamores thence across the creek to the mouth of Clarks branch and with the meanders of the same south 10 west 20 poles, south 40 west 25 poles, south 31 west 50 poles, south 49 west 34 poles, south 83 west 23 poles to the beginning to have and to hold said tract of land with its appurtenances unto the said John C. Bates his heirs and assigns forever and the parties of the first part by their commissioner aforesaid for themselves their heirs executors and administrators the aforesaid tract of land and premises to the said John C. Bates his heirs and assigns will warrant and defend against all persons and claims whatever.
