Barnett/Bernard Noel - Sarah Noel - War of 1812 pension application DECLARATION To be Made where the Party has had a Warrant, and Desires Another. State of Kentucky Owen County On this 19th day of June A.D. One Thousand Eight Hundred and fifty five personally appeared before me, a Justice of the Peace within and for the County and State aforesaid Bernard Noel alias Barnet N. aged 62 years, a resident of Owen in the State of Kentucky who, being duly sworn according to law, declares that he is the identical B. Noel who was a Private in the Company commanded by Captain Peter Dudley in the Regiment of Kentucky Volunteers commanded by Col. Wm. E. Boswell in the war with Great Britain declared by the United States on the 18th day of June A.D. 1812 for the term of six months and continued in actual service in said war for Fourteen Days; that he has heretofore made application for Bounty Land under the act of September 28th, 1850, and received a Land Warrant, No. not recollected for Eighty acres, which he has since legally disposed of and can not now return. He makes this declaration for the purpose of obtaining the additional Bounty Land to which he may be entitled under the Act approved the 3rd day of March, 1855. He also declares that he has never applied for nor received, under this or nay other Act of Congress, any Bounty Land Warrant except the one above mentioned. Moreever, I the said Bernard Noel hereby constitute and appoint R.R. Revill of Owenton Owen County Ky my true and lawful Attorney, to file this declaration, prosecute the claim to which it refers, and for me to receive the Land Warrant when issued thereon. And I empower my said Attorney to constitute and appoint one or more persons as substitutes or Attorney under him, for the special purposes above expressed. B. Noel Claimant. We, J.M. Theobald and R.W. O'Connor residents of Owen County in the State of Kentucky upon our oaths declare, that the foregoing declaration and power were signed and acknowledged by Bernard Noel in our presence, and that we believe, from the appearance and statements of the applicant, that he is the identical person he represents himself to be. O'Connor The foregoing declaration and affidavit were sworn to and subscribed before me on the day and year above written; and I certify that I know the affiants to be credible persons; that the claimant is the person he represents himself to be, and that I have no interest in this claim. State of Kentucky County of Owen On this 22nd day of April, A.D. one thousand and seventy eitht personally appeared before me Jo C. Revill, clerk Owen Circuit Court, the same being a Court of Record within and for the county and State aforesaid, (1) Sally Noel aged 75 years, a resident of Owen County, in the State of Kentucky, who, being duly sworn according to law, declares that she is a widow of (2) Barnett Noel deceased, who was the identical (3) Bernard Noel, who served under the name of (4) Barnard Noel as a (5) private in the company commanded by Captain Peter Dudley, in the regiment of infantry, commanded by Jeptha Dudley in the war of 1812; that her said husband (6) volunteered at Franklin Co Ky on or about the [blank] day of [blank], A.D. [blank], for the term of six months, and continued in actual service in said war for the term of (7) six months, and whose services terminated, by reason of (8) honorable discharge at [blank], on the [blank] day of [blank], A.D. [blank]. She further states that the following is a full description of her said husband at the time of his enlistment, viz: (9) he was aged 19 years Farmer, born in Virginia, about 5 feet 10 inches high. Hair Sandy Blue eyes. Complexion fair. She further states that she was married to the said Barnett Noel, at the city (or town) of [blank], in the county of Owen, and in the State of Kentucky, on the 25 day of February A.D. 1822, by one (10) Davy Lillard, who was a (11) Baptist Minister and that her name before her said marriage was Sally Jones; and she further states that (12) neither she nor her husband had ever previously married and that her said husband (13) Bernard Noel, died at Poplar Grove, Owen Co., in the State of Kentucky, on the 19 day of June 1861; and she further declares that the following have been the places of residence of herself and her said husband since the date of his discharge from the Army; viz: (14) She always lived in Owen County Ky. and her husband lived in Franklin Co Ky till a short time before marriage & moved to owen Co Ky. & lived there till his death. She makes this declaration for the purpose of obtaining the pension to which she may be entitled under the provisions of Sections 4736 to 4740 inclusive Revised Statutes, and the Act of March 9, 1878, and hereby constitutes and appoints with full powers of substitution and revocation C.W. Bennett, ow Washington, D.C., her true and lawful attorney, to prosecute her claim, and she further declares that she has heretofore made no application for (15) land bounty or pension, but her husband about 1855 got a land warrant for said service and that her residence is No. [blank], [blank] street, city (or town) of Poplar Grove county of Owen, State of Kentucky, and that her post office address is Poplar Grove, Owen County Ky.
