Anderson (V) P Cir C Pkg 137 Depositions taken May 19, 1855, in Falmouth. JOHN CASTATOR. I have known the land in contest for 30 years, when it was in woods. I was the first one who cut the first timber of the land. About 15 years ago the old lady informed me that she had purchased it of John Boner and paid her own money for it. She proposed leasing it to me, or that her son William would do it as her agent. In about a week after this conversation I went to the residence of William boner, where the old lady resided, and took a lease for the land from him as the old lady's agent. She said the reason she did not transact the business herself, was that she was getting old. The lease was for two years. The lease was drawn in November and I was to take posession in March. Thomas Boner took posession next after me, but he took it in November, before my lease expired. When I gave the posession to Thomas Boner both the lease and copy were burned. While I was in posession under my lease, I built a house upon the land, sufficiently comfortable for myself and family. I cleared up the old land which had grown up in bushes and briers, and repaired the fencing. That is what I agreed to do in the lease. Thomas Boner was a son of John Bonar, decd. I was 15 years ago this coming november when I took the lease of William Boner as agent for Mary Boner. She was then living with him. I can not read writing myself. I showed the lease to John H. Yelton and he read it. The lease and copy were burned a Wm. Boner's house in November before the lease was out, and at the time Thomas Boner took posession. John (X) Castator Pendleton Co Sct Att. Baker in the town of Alexandria, Campbell Co., Ky. W. S. Crawford (crossed out) I have known John Castator some 14 or 15 years. I would not believe him on oath. G. W. Dean DAVID BAKER. I have known the heirs of John Bonar decd. from their infancy up to the present time. John Boner held the land upon which he died, for some 8 or 10 years previous to his death and after his death William Boner was administrator and he took the land into his posession as admr. of John Boner, and held the land until May or June 1843, at which time I became guardian for Elizabeth, Daniel and Jane Boner, and took posession of the land and held it up to the time H. P. Anderson entered. I was acquainted with Mary Boner for upwards of 50 years; she was the mother of John Boner decd.
