A. Fernald of the city of Portsmouth and state of New Hampshire of the first part and John Grizzle, George Grizzle and William Grizzle of the County of Pendleton and state of Kentucky of the second part,. Witnesseth that for and in consideration of the sum of two thousand five hundred dollars ($2500), one thousand five hundred dollars ($1500) of which is paid and the receipt is hereby acknowledged, the balance of one thousand dollars ($1000) to be secured by two promissory notes XXX equal date herewith, the first note for five hundred dollars ($500) to be due the third day of July AD 1871, the second note for five hundred dollars ($500) due the third day of July AD 1872, both notes to bear interest from the date hereof until paid, hath granted, bargained and sold unto the parties of the second part, all that tract or parcel of land lying in the County of Pendleton, State of Kentucky and on the waters of the East Fork of Grassy Creek, and bounded as follows, to wit, Beginning at a Sugartree at the mouth of Rushes Branch, thence up the creek S48 deg W5,50 chains. Thence S56 1/2 Deg W3.50 chains, N87 1/4 Deg W4.1/2 chains to a Sugartree and Ash above the mouth of a drain and corner to Dorcus Blackburn's, thence with her line S17 Deg E21.50 chains to two Sugartrees, corner to same. Thence S5Deg W19.25 chains to two Sugartrees and Dogwood. Thence N43 1/2 Deg E13.70 chains to a Red Oak on a ridge. Thence N60 Deg W3.25 chains to two Hickories, Foley's corner, thence with his line N41 Deg 21' E33.7 chains to a Buckeye and Hickory (blown down.Thence S49 Deg 52' E30.6 chains to two Elms xxxxxxxxxxxxxx E4.50 chains to a Dogwood and two Ironwoods, thence N18 Deg W21.50 chains to a Sugartree and Honey Locust, on Rushes Branch, thence down said branch N79 Deg W 23 chains, N40 W3.60 chains to a White Oak, thence N73 1/2 W 25.75 chains to the beginning containing one hundred and sixty seven acres, more or less, together with all and singular the improvements and appurtenances thereunto belonging or in any wise appertaining to have and to hold the same forever and the said party for the first part for himself his heirs, executors, administrators and assigns hereby covenant that he will forever warrant the title to the land hereby conveyed against the lawful claim or claims of all persons whatever. Fernald wife of the said Albert having been examined by me separately and apart from her husband acknowledged and declared that she did freely and voluntarily execute and deliver the same to be her act and deed and the contents of the same being fully made known to her did consent that the same might be recorded.
