COMBS, ADMINISTRATOR, PLAINTIFF VS. AND CONSOLIDATED CAUSES SAID COMBS' HEIRS, AND CREDITORS DEFENDANTS --------------------------------------------------------------- On motion of R. S. Brashears a rule is awarded against Josiah H. Combs, administrator of Elijah Combs, is deceased, and Patsey Combs, widow of Jackson G. Combs, deceased and said Jackson G. Combs' heirs which are as follows, Elijah James and Jackson being his sons and Sally Ann, who has intermarried with Stephen H. Hogg, his daughter and all heirs at law of said Jackson G. Combs to share cause why the sale of the land bought by said R. L. Brashear at the sale of the Commissioner under a decree of the Judge of this Court in the above case of Elijah Combs; heirs and Creditors shall not be set aside and he moves to set aside said sale on the following grounds first because he only bid five thousand one hundred and seventy five dollars for said land and signed his name to a blank bond which was afterwards filled up with the sum of $5,180.00 which is five dollars more than he bid (2ndly) on the ground Order Book 110...Page 172 that the lands described in the boundary by your commissioners does not belong to the heirs and assigns as of Elijah Combs, deceased, because a part of said boundary belongs to one Granville Combs and this plaintiff does not know whether Elijah Combs' title is perfect to any of the land which plaintiff purchased of the commissioner under the decree of this Court. (3rd) The widow of Jackson G. Combs, to-wit: Patsy claims her dower interest in the land believing (4th) that the various steps in said case both before and since said sale are and were illegal and void. Submitted by: J.P.
