(Family legend says that During the Civil War, he and his wife was going from Hindman to Lotts Creek and stopped at the home of Mrs. Cornett and while there some soldiers came by, captured him and took him and his wife outside. In a few minutes the others heard shots rang out and when the soldiers had left they found him and his wife hung from a tree. They were buried nearby on Big Branch of Troublesome. This bond seems to help support that legend since it proves he died before 1865. Since his wife not appointed adm she was probably dead by this time also. There are at least two graves at the site he was supposed to be buried at. No names on stones.)
