Carnwell one of Shelby county's oldest and most esteemed citizens, died of heart disease at his home a few miles south of Shelbyville Mrs Splan mother of the trotting horse driver and salesman John Splan has disappeared from st. Joseph's Hospital at Lexington and her whereabouts are unknown James E. Miller chared with picking the pocket of J.A. Geary at Lexington put up $300 bail and disappeared. The cas was furnished by a man giving the name of G.E. Keiser The grand jury at Harlan returned an indictment against Mrs Jo Stewart charging her with the murder of Vina Daniel on Brownies creek, Harlan Caounty. The murder is said to have been the result of jealousy Robert Noaks one of the alleged conspirators has been granted bail in the sum of $2,000 to appear at the Frankfort at the Septmeber term of the circuit court. This bond ws furnished by his attorney J.C. Maynor and Noaks left at once for Virginia When the news of Caleb Powers conviction reached Richmond a heate despute about it arose between L.J. Frazee, Captain of the McCreary Gurards of Richmond, and Cassius Stapp a well known Republican which terminated in Frazee slappping Stapp's jaws. Bystanders separeted them Mrs Nancy Marksbury of Perryville is dead. She was in good health until the great shock she received in seeing her grandson, Henry M. Hughes brought in mingled and dead from being run over by a railroad train three weeks ago. She was in her eight first year Mrs Robert White of McKinney attempted suicide at lexington by taking morphine. Mrs White had been separated from her husband and she had gone to lexington where she located him. He refused to make up and she then took the poison. She will recover GUILTY Says The Jury in Case of Caleb Powers. Life Sentence was Given FIRST TO SPEAK IN The Jury Room was a Republican..Changed Mind After Hearing the Evidence Against Powers Youtsey Went Into Trial Yesterday Although Quite Sick The case agains Caleb Powers was given to the jury at 1 o'clock pm Saturday. Only fifty three minutes were consume in the jury room before they brought in a verdict of guilty against Powers, one of the accused accessories to the murder of William Goebel. Two ballots were taken, the first ballot stood eleven for life improsonment and one for hanging the second ballot all agreed on a life sentence. Powers will try for a new hearing. The case against Henry E. Youtsey charged with the murder of William Goebel was called Monday, but continued until Thursday on account of the illnes of the defendant. Teh attorney's for the defense asked that the case be continued until the October term of the court on the grounds that Taylor and finley were two very important witnesses and that they would be ther eto testify for Youtsey at that time, but Judge Cantrill immediately overruled the motion saying "There wa sno assurance that the two men would be here at the time" Youtsey will in all proba bility be the last of the assassins to be tried at this term of the court. Talks with jurors after they left the courthouse at Georgetown developed the fact that the 53 minutes consumed in the jury room was taken up mostly with reading aloud the instructions and waiting for Judge Cantrill to return. When the jurmen entered their room Juror Stone the oldest man on the panel was elected foreman. Juror Porter the only Republican on the jury was the first to speak. he said "Gentlemen I am a Republican and I have said that I did not believe Goebel's murder was the result of a conspiracy. I did not think Caleb Powers could be guilty but I have heard the eveidence and I am convinced he is". Others alsom made talks and it is said that one o the men on the jury intimated that he thougth the death penalty ought to be inflicted. However, when a ballot was taken all 12 of the jurors voted for life imprisonment. Porter school teacher, Republican Alonzo Kemper farmer, One of the jurors said tonight that the jurymen were influenced in making up their verdict by many things in the eveidenc, but that some of the chief points were Powers' own admission on the stand that he organized the crowd of 1,200 armed mountain men which came to Frankfort January 5, his corroboration of parts of the testimony of Noakes, Golden and Cutton the evidence that he gave Youtsey the key, and that the shot was fired from his office. Mercer his wife and two sons aged twelve and fourteen years are in jail at Hardinsburg, Ky charged with the murder of Thomas Gannaway, aged eighty five years, details of which were published in Saturday's Times. Ash and Clay Miller $20 each for desturbing religious worship at New Hope. Ed McClure and Jim Doan 42.50 each for shooting on public road, Robert Riddle $5 for striking Mrs Hurt J.J. WILLIAMS DEAD J. J. Wiliams aged 73, died of heart trouble at his home in this place at 6:45 am Monday morning. For several months it had been a struggle between life and death with him. Not since his store house burned here three years ago, this summer, has he tried to engage in any active business more than to look after his already large accumulated fortune. Mr Williams was the wealthiest man in the county and one of the of our citizens who has suceeded in making an independant fortune. He leaves a wife and six children to mourn the loss of a devoted husband and a kind and affectionate father. Many times we have heard it said that there was nothing in his power that he was not willing to do for his family his family's pleasure was his pleasure and that we can say of but few men. The funeral services took place from the Christian church at 8 am Tuesday morning conducted by Rev Cole after which the burial took place in the cemetery. DEATH: A telegram from Alliance Nebraska late Sunday evening brought to the friends and relatives in this county the sad news of the sudden and untimely death of B.C. Richardson. Mr Richardson left this county early in the Spring and went to Alliance, nebraska, where he erected a fine brick building and engaged in the grocery business. On last Sunday a strollling musican by the name of Cline came into his place of business accompanied by a lady, Cline was very boisterous and during the conversation the lady became offended at some remark made in the store by whom it was made is not known and Cline immediately started a fight in which he was knocked down by Richardson. Cline and the woman were both put out side of the building and went off, every one thinking the trouble was over but Cline soon secured a revolver and returned hunted Richardson up and as soon as he found him opened fire one shot taking effect in the stomach and the other in the shoulder. Richardson died Sunday night. Cline was arrested and placed in jail. R Richardson's remains were brought to Berea his old home, Wednesday morning where the buraial took palce Wednesday afternoon. Richardson leaves a wife and six children besides a host of friends to mourn his loss. The case of Henry Youtsey charge with the murder of Gov Goebel and Holland Whitaker, John Davis and Tailow Dick Combs, indicted as accessories were continued until Oct 2. Youtsey was too ill to stand trial now and the attorneys agreed to let the other cases go over.
