All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ky/kyfiles.html ************************************************ File contributed for use in USGenWeb Archives by: Paige Walk walkp_@hotmail.com September 14, 2013, 11:03 am Source: Scott Co,ky Wills, Book O, Pgs 23, 24 & 25 Written: January 4, 1858 Recorded: July 1862 Scott Co, KY Wills Book O Pages 23, 24 & 25 I JOHN CARTENHOUR SEN of Scott County Kentucky do hereby make my last will and testament as follows to wit 1st I direct all my just debts of every description and my funeral expenses be paid 2nd I give to my beloved wife ELIZABETH CARTENHOUR my negro girl AMANDA aged about twenty years to have & to hold during her natural life & I hereby direct my executor hereinafter named out of the money on hand & of the first money coming to his hands from my estate to pay the sum of two thousand dollars to WILLIAM S HOLCRAFT to be by him held & managed for the use & benefit of my said wife and on which said HOLCRAFT will pay annually to my said wife interest at the rate of six percent per annum for and during her natural life and after her death he will distribute said sum of two thousand dollars equally between the children of my daughters EDNEY BURTON MAHALA COOK & REBECCA HOLCRAFT 3rd I give to GEORGE COOK the land recently conveyed to me by BEN JONES and ELIJAH TURNER containing about forty six acres & fifteen hundred dollars in money to be held in trust for the use & benefit of my daughter SALLY A RAWLINS for and during her natural life & he is directed to pay out annually the interest on said sum of fifteen hundred dollars for the clothing and education of my said daughters children as he may think best & at the death of my said daughter & her husband JAMES RAWLINS he the said COOK will distribute said land and money equally among my said daughters children & if necessary execute deeds of partition among them 4th I have heretofore given to my son JOHN CARTENHOUR JR one hundred & thirty nine acres of land purchased of [sic] by me of Wm WIGGINGTON for which I have had a conveyance made to him & have given to him two negros to wit HENRY (?) & MARY & I now give him eight shares of my stock in the Georgetown & Dry ridge Turnpike Road and all my millwright tools 5th I give to my daughter AGATHA OSBORN fifteen hundred dollars 6th I give to Wm BURTON six shares of stock in the above named road and all my books 7th I give to GEORGE COOK & W S HOLCRAFT each six shares of stock in the above named road 8th I direct that the negro girl AMANDA after the death of my wife shall go to my grandson ALONZO CARTENHOUR to him & his heirs forever 9th I direct all the rest of my estate real personal & mixed to be sold by my executor as soon after my decease as convenient & the proceeds of such sale and of my entire estate after the payment of my debts and the legacies above named and all proper expenses incident upon the settlement of my affairs to be equally divided between the children of my daughters EDNEY BURTON MAHALA COOK & REBECCA HOLCRAFT Tenth I hereby appoint WILLIAM BURTON of this my last will and testament & request the court to require no surety from him and his bond as [illegible] In Testimony whereof I have hereunto set my hand this 4th day of January 1858 Attest JOHN CARTINHOUR SR M. SAMUELL “Codicil” I JOHN CARTENHOUR of Scott County Kentucky being of sound mind and disposing memory do make this as a codicil to my last will and testament by me heretofore made and dated 4th January 1858 & witnessed by M POLK C.J. POLK & J.W. SAMUELL & I now direct that all my household furniture of every description to be valued as soon after my decease as practicable by three disinterested persons who are to be sworn faithfully to discharge the duties herein required of them and after said valuation is made out these my four daughters MAHALA COOK SALLY A RAWLINS REBECCA HOLCRAFT AGATHA OSBORN & my grand daughter SALLY A BURTON are each to have one equal fifth part thereof ---- And for the purpose of facilitating this division & with the hope that it may be accomplished with good feeling & proper sisterly affection. I direct that said appraisers do divide said household furniture into five equal parts as nearly as may be & let my said daughters & grand daughter draw lots for their portions separately This dispersion of said household furniture is made with the strict injunction on my part that said property is not to be sold by my executor or by my said daughters or grand daughters [sic] or given away by them except such sale or exchanges as they may see fit to make among themselves my object being to prevent this part of my estate from being hauled about after my death Lastly I appoint my son in law Wm BURTON & my son JOHN CARTENHOUR JUN executors of my said last will and testament and of this my codicil to the same and hereby request the court to require of them no security on their bond as such In Testimony whereof I have hereunto signed my name this 23rd day of January 1862 JOHN CARTINHOUR SR Att M POLK } E THORNBERRY T.J. STUCKER Scott County Sct July Term 1862 A writing purporting to be the last will and testament and codicil of JOHN CARTENHOUR deceased was this day produced in open court and proven by the oath of M POLK and of the subscribing witnesses thereto who also testified that C J POLK & J.W. SAMUELL the other subscribing witness thereto attested said will in the presence of said M POLK and in the presence of said JOHN CARTENHOUR SR and at the request of said JOHN CARTENHOUR SR Also the codicil of said will which was proved by the oaths of M POLK & T J NUTTER two of the subscribing witnesses thereto who also proved that E. THORNBERY [sic] & G STUCKER the other subscribing witnesses to said codicil also attested said codicil in their presence and the presence of said JOHN CARTENHOUR SR and at his request Whereupon said will & codicil is ordered to be recorded Att J C APPLEGATE Clk [illegible] WALLACE.
