In the Name of God, Amen, the twenty ninth day of June, eighteen hundred and twenty two, I, Jacob Mulberry of the County of Scott and State of Kentucky, calling to mind the mortality of the body and knowing that it is appointed unto all men once to die, do make and ordain this my last will and testament that is to say principally and first of all I give and recommend my soul into the hands of almighty God that gave it and my body I recommend to the earth to be buried in a decent Christian burial at the discretion of my executors as named in this will and as touching my worldly estate wherewith it hath pleased God to bless me with in this life. I give devise and dispose of in the following manner and form..First I give to my son James one hundred acres of land whereon he now lives, also I give to my daughter Polly Neale, the land whereon she now lives it being fifty acres more or less also I give to my daughter Betsy Mallory one hundred acres of land whereon she now lives and it is my desire that executors out of my estate pay forty dollars to George Mallory as so much I have received of him. Also I give to Elizabeth Trotter fifty acres of land to include said Trotters improvement whereon she now lives during her life, and at her death to decend to her children equal. Also I give to my daughter Lucy Peck one hundred acres of land whereon she now lives. Also I give to my son Joel Mulberry one hundred and fifty acres of land to include the saw mill and the farm whereon I now live. Also I give to my son William Mulberry one hundred acres of land whereon he now lives to include his improvements and it is my will that my two sons William and Jowell own the saw mill jointly and equally between them and it is my will that my executors as named lay off said land at discretion. Also I give to my son John Mulberry one dollar to be paid out of my personal estate....also I give to my daughter Nancy Pigg one dollar to be made out of my personal estate also it is my will and desire the rest of my estate both real and personal equally divided among all my children. And it is my will that my friends Garrett Wall and John Mulberry be my executors and carry the same into effect; to this my last will and testament according to the law. First, I will and bequeath my soul to God who gave it. Second, I wish my entire estate both personal and real equally divided between my children, commencing with my oldest Jacob, Martha, Mary, John Vance, William, Lucy Jane, Catherine, and Lavinia Ann, and that that portion of my estate that will be coming to my daughter Martha, shall be held in the hands of my executors, and to be be given to her as she may need it, and at her death it is to be equally divided between her bodily heirs. I also make it known here, tat I have alloted to my daughter Lucy Jane, that portion of my landed estate that I intend as her part, and have conveyed the same by Deed. I John Lemon of Scott County and State of Kentucky being weak of body but of sound mind and memory .....do make and ordain this my last will and ...........(10 lines missing due to fire) and the remaining property above mentioned divided among my children and step children John Lemon Junr, James Lemon, George Lemon, Mary C. McCail, Jane Mulberry my step daughters Anne Lemon..... Thirdly and lastly I do constitute John Lemon and .....Lemon my sole executors of this my last will and testament. Administration of Estate for JOHN MULBERRY Scott County, Kentucky Order Book A, p. 106 On the motion of William Davis administration is granted him on the estate of John Mulbery dec'd who there upon took the oath and entered unto and acknowledged his bondon conditioned (?) as the law directs. Order that Benj. Quinn, Jacob Moore and Nathaniel Sherman (?) or any two of them appraise in current money the personal estate and slaves if any of John Mulbery decd and return an inventory thereof to the court. Will Book A, p.49 (Index says p. 47) Scott County, Kentucky Know all men by these presents that we William Davis and Ackhillis Stapp are held and firmly Bound unto John A. Miller, Radis (?) Smith and James Jhonston Gentlemen Justices of the County Court of Scott in the sum of one hundred pounds current money to be paid unto the said Justices or their successors the payment whereof well and truly to be made we bind ourselves Exors & Admorhd firmly by these presents sealed with our seals and dated this 22nd day January 1798. The condition of the above obligation is that if the above bound William Davis Administrator of the goods chattle &credits of John Mulberry decd do make or cause to be made a true and perfect Inventory of the said goods chattles & credits which now have or at any time here after shall come to his possession or knowledge or to the possession of any other person for him and the same so made do Exhibit into said county court when thereunto required and in all things Administer on the said Estate as the law directs and remand to court an account. Of all his proceedings thereon then the above obligation to be void otherwise to remain in full force and virtue.
