I JOHN MILLER of the county of Scott and State of Kentucky being of sound mind & disposing memory do make this my last will and Testament. First I desire that after my decease all my just debts be paid Secondly I give to my daughter ELIZABETH my negro boy REASON. I give to my daughter SARAH my negro girl ARAH. (Said negroes having been given to them by their brother JNO A MILLER while they were infants) I also give to my daughter SARAH my negro boy CHARLES I give to my son JNO A MILLER my Negro man PAUL. I give to my son GARETT H [sic] MILLER five hundred dollars I give to my Grand Daughter ELLEN LINDLY late ELLEN MILLER fifty dollars I give to my grand daughter SARAH ELIZABETH daughter of JAMES D MILLER dec’d fifty dollars. I give to my daughters SARAH & ELIZABETH all or any part of my household and kitchen furniture including Beding [sic] etc which they may choose to take. Then the residue of my estate both real and personal I desire shall be sold by my Executors or such of them who may survive (?) or qualify for the best possible price and the proceeds of sale to be applied first to the discharge of the foregoing Legacies and the remainder to be equally divided among my nine children To wit To my daughter ELIZABETH one part To my son[s] JOSEPH E MILLER, JNO A MILLER WILLIAM H MILLER DAVID F MILLER THOMAS S MILLER GARRETT W MILLER RALPH P MILLER each one part and one part to my daughter SARAH The bequests made to my daughter SARAH are to pass at her death to her son JNO J GRIFFITH if he is then alive, if not to such of the family as she may name. The bequests made to my daughter ELIZABETH are to pass at her death to her son EDWIN CLIFTON if he is then alive, if not to such of the family as she may name. My son JOSEPH E MILLER is justly indebted to me in the sum of three hundred & fifty dollars with interest at the rate of six percent from the 18th of September 1820 (?) till paid. Which will appear from the enclosed blank bill of exchange drawn on the Branch Bank of the United States at Natchez being the 2nd draft The 1st of the same time (?) and date having been sent to my son JNO A MILLER in the lower country. This amount must first be paid & added to my estate before the afors’d division of nine equal parts is made. If any devisee or devisees shall not abide the provisions of this will but shall attempt by suit or otherwise to set it aside then it is my will that they shall not have any part of my property but whatever may have been bequested to him her or them shall be divided equally amongst my other children. I desire that my daughter SARAH shall have some reasonable time after my demise to procure for herself a home [illegible] from one to three months possession of the house in which I now live which will not interfere however with the sale of property and the foregoing provisions of this will. I appoint DAVID F MILLER THOMAS S MILLER, and my friend, DAVID EMISON and HIRAM WOOD, or such of them as qualify or the survivor or survivors of them EXECUTORS to this my last will and Testament. And I do hereby revoke any former will by me made.
