All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ky/kyfiles.html ************************************************ File contributed for use in USGenWeb Archives by: Paige Walk walkp_@hotmail.com September 19, 2013, 9:24 am Source: Scott Co, Ky Wills, Bk F, Pgs 154 & 155 Written: August 18, 1812 Recorded: June 1838 Scott Co, KY Wills Book F Pages 154 & 155 I THOMAS STORY at present of Scott County being about to set out on a Military Expedition do make this my last will and testament first It is my will that all my just debts and funeral expenses be paid out of my Estate Second I give and bequeath to my brother JOHN STORY twelve Hundred dollars to be laid out and appropriated immediately on my decease in a farm to be purchased to the best advantage by my Exors herein after named And in the most Effective manner secured for the benefit of his children now living and their heirs being intended solely for their care and benefit Third I give and devise to PARTHENIA wife of my Brother JOHN fifty dollars in cash and to each of his five children now living twenty five dollars Fourth I give and bequeath to My Sister MARGARET OFFICER now in Pennsylvania fifty dollars in cash and one Hundred dollars to be Equally divided among her children now Living Fifth I give and bequeath to my Sister SALEY (?) SLOAN in Pennsylvania one Hundred and fifty dollars in cash to her and her children Sixth I give and bequeath and devise to Wm STORY and his Heirs the entire remains of my Estate both real and personal excepting as herein after excepted Seventh I give and bequeath to the children of my Brother WILLIAM one hundred and fifty dollars to be Equally divided among them Eighth It is my will that HARVEY (?) GRASS (?) his wife ESTHER and her Children LEAH DINAH and her infant child now a sucking babe who are at this time my slaves at my decease be immediately Emancipated and set free according to law by my Executor and I do hereby Emancipate my negro slaves at my decease as aforesaid And I do further order that my negro slaves afore named be Emancipated & set free immediately on my decease And that before any of the bequests and legacies herein mentioned shall take effect or be distributed Ninth I give and bequeath to DAVID WALLACE my youngest gray mare & my saddle & bridle I do hereby appoint Major JOHN [illegible] and FRASHER (?) TAYLOR of Woodford County Executors of this my will And as also [sic] appoint my brother Wm STORY as Exor of this will In witness whereof I have hereunto set my hand and seal this 18th day of August 1812 acknowledged in presence of ABRAHAM STITS THOS STORY JOHN MILLER JOSEPH E MILLER Codicil For the better understanding of the bequest of $1200 mentioned in the foregoing will to JOHN STORY and children I do further specify and will that the object of that bequest is to provide a house and place of residence for the said JOHN STORY and family from which the said JOHN STORY and his present wife while she remains his widow in case of his death shall be divided (?) or dispersed (?) during their natural lives and if in case the said JOHN STORY shall wish to move to any other place then it is my will that the farm to be purchased as aforesaid may be sold by my Executors aforesaid And the proceeds thereof to be vested in another farm for the same intent as the foregoing will and this codicil mentioned Dated August 18th 1812 Acknowledged in the presence of THO STORY ABM STITS JOHN MILLER JOS E MILLER Scott County Sct June Court 1838 The foregoing last will and testament of THOMAS STORY dec’d and a codicil thats attached was this day produced in open Court and the body of said will and signature of ABRAHAM STITS was proven to be the Hand (?)
