SMITH to Armstead JONES. SMITH died shortly after making the conveyance, leaving James M. SMITH, Joseph N. SMITH, Mary Margaret SMITH & Mildred Turner SMITH his only heirs, the last three being under the age of twenty one years and as a consequence of their infancy, unable to make title to JONES who asks that the court appoint a commissioner to convey the title to JONES.
