Lena Shelby County Clerk’s Office, Shelby Co., KY 1857 Land Record--Shelby County, Kentucky Deed Book U-2 pg. 488 [Ross to Threlkeld] This Indenture made this 30th day of October 1857 between L. T Ross of the one part and William A. Threlkeld of the other part both of the County of Shelby and State of Kentucky witnesseth that whereas the said L. T. Ross together with his Sanford V. Ross are indebited by note to said Threlkeld in the sum of Three Thousand two hundred and twnty seven dollars and thirty cents dated the first day of March 1855 and due one day thereafter no part of which has been paid and where as the aid L. T. Ross in conjunction with his brother the said Sanford V. Ross (who has executed a deed of mortgage of ___ date herewith upon certain lands in Shelby County owned by him for the like purpose) are desirious of securing to the said Threlkeld the payment of the said note together with whatever of interest has and may accure then on Therefere this Indenture witnesseth That the said L. T. Ross for and in consideration of the premise afore stated as well as of one dollar _ in hand paid the recept whereof is hereby acknowledged hath granted bargained and sold and by these presents does grant bargain sell and convey unto the said Wm A. Threlkeld his heirs and assigns all that tract or parcel of land situate and being in the county of Shelby on the waters of Beech creek and conveyed by one Jacob Watts to the said L. T. Ross and bounded as follows to wit Begining at a stake in a small draw corner to William Corbin S 70 E33 poles to a branch Thence down said branch S 25 W 41 1/2 Poles to two beeches corner to S. V. Ross line Thence with said line S 67 1/2 E23 poles to two beeches on a branch Thence up the same N 73 1/2 E25 1/2 poles Thence N 81 E26 poles to two beeches corner in Shouses line Thence with said line N 27 1/2 E 149 1/2 poles to a beech and small oak corner to Taylor Thence S 28 W 81 poles to a stake corner in Taylors line Thence N 71 W 22 poles to a stake S 38 W 30 poles to a stone corner to Corbin Then a S24 W 30 1/2 poles to the Beginning containing Eighty two acres [insert] one quarter and thirty poles [end of insert] be the same more or less together with all and singular the appuntenances thereever to belonging or in any wise appertaining To have and to hold the land hereby conveyed with the appertunances unto the said Threlkeld his heirs and assigns forever And the said L T Ross for himself his heirs executers a aministraters the aforesaid tract of land and appurtenances unto the said William A. Threlkeld his heir or assigns against the claim or claims of all and every person or persons whatsoever doth and will forever warrant and defend by these persents The condition however of the above Indenture is this that if the said note above mentioned due the said Threlkeld shall be well and truly paid off to him the said Threlkeld his heirs executed or administrates or assigns together with whatofever interest that may have accured therein there in that case the Indenture is to be null an void otherwise to be and remain in full force and virtue. I witness whereof the said L T Ross hath therewith set his hand and affixed his seal the day and year first above written L T Ross Kentucky Shelby County &Ct I H. A Chinn Clerk of the County Court of the County of ssa certify that this deed of Mortgage from L T Ross to W A Threlkeld was this day produced to me in my office and acknowledged by said L T Ross to be his act and deed whereupon said deed and this certificate is admitted to record in my office. Given under my hand this 2nd day of Mr 1857 at 30 minutes past 8 o’clock. Ate. Threlkeld of the other part both of the County of Shelby and State of Kentucky witnesseth That whereas the said Sanford V Ross together with L T Ross are indebted by note to the said Threlkeld in the sum of Three Thousand two hundred and twenty seven dollars and thrity cents dated the first day of March 1855 and due one day after date no part of which has been paid and whereas the said Sanford V Ross in conjuinction with his brother L T Ross (who has executed a deed of Mortgage of even date herwith upon a certain tract of land own by him in Shelby County for the like purpose) are desirous of securing to said Threlkeld the payment of the said note together with the whatever of interest has and may accure thereon Therefore this Indenture Witnesseth That the said Sandford V Ross for and in consideration of the premises above recited as well as of one dollar in hand paid the receipt whereof hereby acknowledged hath granted bargained and sold and by these presnets does grant bargain and convey unto the Wm A Threlkeld his heirs and assigns all those tracts or parals of land situate and being in the County of Shelby on the waters of Beech creek and conveyed by Isaac Brumly his wife to the said Ross by deed being dated the 27th day of August 1849 Recorded in Book O 2 page 82 in the Shelby County court-clerk office and Bounded as follows (to wit) Beginning at a stone corner to Daniel Brumley in said Ross line and running to a southerly direction with said Daniel Brumley line to a corner in Beech creek corner to said Brumly in the line of John W Campbell heirs Thence a Easterdly with said heirs line to a small red oak corner to said Ross in said heirs line Thence with said Ross s ___ line in a Northerly direction to a stone corner to said Ross in Corbins line Thence Westerly with said Ross s line to the Beginning containing minteen acres and one quarter be the same more or less one other tract or parcel of land conveyed by Albert Saunders and wife to the said Ross by deed bearing date the 8th day of August 1848 recorded in the Shelby County court-clerk office in Book 2 No 2 page 86 and bounded as follows (to wit- Beginning at a white walnut and ash stump corner to Isaac Brumley in E ary Williams and Thence with the same N 33 1/4 E 86 poles to a stone corner to said Williams Thence S 69 E 61 poles to a stone corner to John Taylor Thence with a line of the same S 30 W 84 poles to a stone corner to William Corbin Thence N 69 W 66 poles to the Beginning containing thirty three acres and one half of an acre be the same more or less one other tract or parcel of land situate and being in said county of Shelby in the waters of Beech creek conveyed by Isaac Brumley and wife to said Ross by deed bearing date the fifth day of August 1853 and recorded in the Shelby County court-clerk office in book R No 2 page 500 and bounded as follows (to wit) Beginning at a stone in Williams line S 25 W 41 poles to a stake Thence N 60 1/2 W 29 poles to a stake Thence S 211 W 80 poles to a stake Thence N 88 E 49 poles to a stake in Scotts line Thence with the same 44 1/2 poles to a beech stump on a branch corner to S Ross Thence with said Ross s original line N_32 poles to a stake corner to said Ross Thence N 8 E 93 poles to a dogwood and cedar Thence N 73 W 18 poles to a walnut and ash stump in Wm Williams line thence s 39 W 36 1/4 poles to a stone corner to Wm Williams Thence N 41 W 11 poles to the Beginning containing fifty acres one quarter and 28 poles be the same more or less and also a fourth tract of parcel of alnd situate and being on beech creek in the County afsd conveyed to said Ross by Arthur Busey by deed recorded in the Shelby county court-clerks office and bounded as follows to sit Begining at two beeches and branch corner to F G Scott Thence with the meanders of said branch S 81 W 60 poles Thence S 71 W 39 1/2 poles Thence S44 1/4 W 32 poles Thence N 2 3/4 W 20 poles to a small oak on said branch corner to Isaac Brumley Thence with his line N 31 E 94 poles to a s tone in a branch Thence S 63 E 102 poles to the Beginning containing thirty acres be the same more or less together with all and singular the appurtenances thereunto belonging or in any wise oppertaining To have and th hold the lands hereby conveyed with the appurtenances unto the said Wm A Threlkeld his heirs and assigns forever and the said Sanford V Ross for himself his heirs Executors and administrates the afsd tract of land and appurtenances unto the said William A Threlkeld his heirs or assigns against the claim or claims of all and every person or persons whatsoever doth and will forever warrant and defend by these presents It is understood however between the parties hereto that our of the above four tracts of land conveyed by the deed there is excepted above 41 acres of land heretofore sold by the said Ross off the main part of the same to one Frank Shouse The condition however of the above Indenture this is that of the said note above mentioned due to the said Threlkeld shall be well and truly paid off to him the said Threlkeld his heirs executers administraters or assigns together with whatever of interest that may have accrued thereon there and in that case this Indenture is to be null and void otherwise to be and remain in full force and virtue In witness whereof the said Sanford V Ross hath hereunto set his hand and seal the day and year first above written.
