(to wit) first I give unto my wife Nancy Gill the farm I now live on during her natural life. I also give her all my negroes to wit, Lucy, Rachal, Andrew, Mary, Sarah, Jane and there increase during her natural life - also all my stock of horses, cattle, hogs, and sheep, household and kitchen furnature during her natural life. and 2nd it is my will that after the death of my wife, my son James Gill is to have all my land, farming utensils, stock or horses, cattle, hogs, sheep - clock, cupboard and desk, and the ballance of my household and kitchen furnature to be equally divided between my son James Gill and my daughter Katharine Gill, it is further my will that my daughter Katharine Gill have a negro girl named Charlott, it is further my will that the above named negro girl Rachall be free at the death of my wife. I also will that all the balance of my negros, to wit, Lucy, Andrew, Mary, Sarah, Jane, and all their increase at the death of my wife be equally divided into seven parts and distributed as follows. My son Beedy Gill to have two parts and to pay to James Gill, Betsy Bullard, Katharine Gill and Nancy Robertson twenty pounds to be equally divided between them. My son George Gill to have one part and to pay twenty pounds as above named, Betsy Bullard to have one part, Katharine Gill to have one part. James Gill to have one part and Nancy Robertson one part, and further I will one dollar to my son Thomas Gill, and as I now have some money on hand and some owing to me, it is my will that if any of the money should remain at the death of my wife the same shall be equally divided between my son James Gill and Katharine Gill and lastly I make and ordain my son James Gill executor of this my last will and testament. Whereunto I have set my hand and seal this twenty eighth day of May 1821 Lazarus Tilley James Gill (seal) James C. Burnett Pryor Burnett I have altered my will so far as relates to freeing my girl Rachal but entend to dispose of her otherwise as I think it will be better for her to have a good master that to be free as I find her not capible of managing for herself so witness my hand this 18th day of May 1826 James C. Burnett James Gill (seal) Shelby County, March term 1830 A writing proporting to be the last will and codicil thereto anexed of James Gill decd. was produced in court, whereupon Lazarus Tilley, James C. Burnett and Pryor Burnett, subscribing witnesses to said will, being sworn, state that said writing was signed and acknowledged by the said James Gill, as and for his last will and testament, that they believe he was of sound disposing mind and memory at the time of doing the same and the said James C. Burnett and F.G. Burnett, subscrbing witnesses to the codicil being also sworn, state that said codicil was signed and acknowledged by the said James Gill to be his act and deed and that they believe he was of sound disposing mind and memory at the time of doing the same, which will and codicil is ordered to be recorded and thereupon James Gill executor named in said will, came into court and took upon himself the further of the execution thereof, and having taken the oath required by law, and entered into bond with George Gill and George Shindler his securities in the penalty of $5000.00, conditioned as the law directs, probate thereof is granted him in due form of law.
