I Robert Miller Senior of the state of Kentucky and county of Shelby, being old and infirm but of a sound mind and disposing memory do make and declare this to be my last will and testament in the manner following _______. First my desire is that all my last debts and funeral expenses be paid. 2nd. Where as a marriage contract exists between me and my present wife Peggy Miller my desire is that she may receive at my death every thing that she is entitled to by virtue of said contract which we entered into previous to our marriage. 3rd. I give and bequeath unto my son George P. Miller the three hundred dollars which he now owes me. 4th. My son in law John Baskett has received fifty dollars in part of my daughter Sally's portion for which I hold an account against said Baskett, no interest is to be paid by said Baskett on said account. 5th. My son John has received twenty five dollars which is to be considered as part of his portion of my estate and my desire is that my executors pay out of my said son John's part of my estate the sum of seventy dollars which I agreed to pay for him at my death, also a five dollar note with the interest thereon which my son executed to my wife Peggy. 6th. And my desire is that the part of my estate which my son Francis will be entitled to should be for the use and benefit of his children, but my executors are directed to pay over said portion to my said son Francis. 7th. And my desire is that my son James receive forty dollars out of my estate before it is divided and my executors are directed to pay the said forty dollars to my wife Peggy Miller in discharge in part of a note which she holds on my son James for seventy eight dollars fifty cents and bares date 15th day of February 1819. But if said note should be paid off before my death then the money is to be paid to my son James. 8th. My daughter Patsy having departed this life without any issue therefor her portion is to be equally divided between my several children except my son George. 9th. My will is that the part of my estate which my daughter Caty Hathaway will be entitled to be not only for her use and benefit during her life but to be disposed of at her death as she may think proper. 10th. My will and desire is that my son in law John Baskett take if he chooses my two servants Lucinda and Spencer at their appraisement, and If he should not choose to take them then any of the children may take on the same terms. 11th. And my further desire is that my son in law William Cravens take my two servants Delpha and her child Rachel back at their appraisement, but If he should not take them then any of the rest of my children may take them on the same terms. 12th. And my further desire is that the whole value of my estate not other- wise provided for be sold and equally divided between all my children, except my son George, he having received his share of my estate. And lastly, I do appoint my two friends James Ford and William W. Ford my executors to this my last will and testament. In witness where of I have here unto set my hand and seal this tenth day of February one thousand eight hundred and thirty. Was signed and acknowledged by ____ Robert Miller Senior, died and as for his last Will and testament and that they believed he was of sound deposing mind and memory at the time of doing the same which Will is ordered to be recorded and there upon James Ford and William W. Ford the executors named in said Will came into court and refused to take upon themselves the ____ of the execution of said Will, and renounced the executor- ship there of which is ordered to be certified and on motion of William W. Ford and _______ and they having taken the oath required by law and entered into ____ with William Bl___ and John _____ there security in the ____ conditioned as the law directs.
