KY Will Book B p. 526 December County Court 1844 On motion of SUSANNAH HARDESTY it is ordered that HUMPHREY MAY, JONATHAN DAVIS, CHARLES B. MAY and JAMES TICHENOR or any three of them being first sworn do lay off and assign to the said SUSANNAH HARDESTY her Dower in the lands and slaves of which her deceased husband CALEB HARDESTY died Seized and possessed and make report thereof to the Court. JONATHAN DAVIS and CHARLES B. MAY personally appeared and was duly sworn... In obedience to an order of the Spencer County Court directed to the undersigned Com’r requiring us lay off and assign unto SUSAN HARDESTY her ___ (they left a blank here) in the lands and slaves of which her husband died seized and possessed and make report thereof to Court and do report that we met at the late residence of CALEB HARDESTY Dec’d on the 9 Dec 1844 and proceeded to lay off the same accordingly. Beginning at a stone corner to JEPTHAT BERKLEY and in a line of WM. H. MAY thence with his line north 45 west 86 poles to a stone below the mouth of the cave then with a line of fence so as to include the meadows and barn... south to a stone Corner to JEPHTHAH BERKLEY thence with is line to the beginning including improvements, Horse mill and fixtures Containing 40 acres also another tract of timbered land adjoining NATHAN CAINE beginning at at a stone corner to said CAINE thence north ... To the road leading from Taylorsville to Bloomfield thence to JEPTHATH BERKLEY’s Corner...containing about 16 acres... also one negro man named CHARLES. All respectfully submitted to the Court. KY Deed Book C p. 38 CALEB HARDESTY of Spencer County and State of Kentucky to SAMUEL BENNETT of the same County and State... that for and in consideration of the Sum of one dollar to me in hand paid have granted bargained and sold a certain parcel of land lying and being in Spencer County on the Waters of Salt River and the Same which LEWIS JENNINGS now lives on and more particularly described in a Deed of Conveyance made by the s’d JENNINGS to me the said HARDESTY now of record in the Office of Nelson County Court with all and singular appurtenances supposed to contain fifty acres be the same more or less ... I the said HARDESTY for the consideration of one dollar more and under considerations hereinafter mentioned hath this day granted bargained and sold one trunnel bed and furniture, one large Bed, Bedstead and furniture thereunto belonging five chairs, one cow, twelve hogs, five sheep, one folding leaf table, one lot of corn supposed to be thirty two Bushels, part of which property I purchased at public Sale at LEWIS JENNINGS and for the same hold the officers receipt. To have and to hold the aforesaid property in its different Species and description and all the increase and profits thereof accruing or that may here after accrue to him the said BENNETT his heirs and assigns forever And I the said HARDESTY for my self heirs and the premises with the appurtenances, aforesaid together with the personal property before named, will warrant and defend from the claim or claims of my heirs and all others claiming by through or under me. This Indenture is upon the trust and consideration following Towit: That the said BENNETT as Trustee for my daughter MARY JENNINGS and her children towit, NANCY, WASHINGTON, SUSAN, CALEB, SALLY and WILLIAM WALLER JENNINGS do use appropriate and apply the property aforesaid both real and personal the rents profits and increase in such a manner in such times as she wants and or necessities of my Daughter MARY JENNINGS and her children may require to their only proper use benefit and Support and be it understood that the purchase of the property aforesaid by the said BENNETT and the Sale by me the said HARDESTY is intended and fully calculated for the benefit of my Daughter MARY JENNINGS and her children.
