Witnesseth that on the fourth day of August 1828 the said WEEKS did Execute a Deed of Gift to the said MARIA WEEKS his daughter now MARIA CLARK conveying to her and her heirs the following Negroes named to wit: KITTY and her daughter MARY together with their increase also KITTY’s three sons, HIRAM, ALFRED and ISAAC until they Should arrive at the age of twenty four and at that age they were to be Set free to wit the three boys nor the said WEEKS being not Contented in Mind in Consequence of giving to much to his Daughter in exclusion of his other children. It is therefore agreed and understood their title to KITTY, HIRAM, ALFRED and ISAAC all the other property deeded to them as afors’d except MARY which is now in their possession and Said deed dated 4 August 1828 Now recorded in the Spencer Co. Court Office is to be canceled set aside and held nought from this date upon this Correction that the said JAMES WEEKS, father of MARIA CLARK will in the distribution of his Estate at his death make the said MARIA CLARK’s share and portion of the Estate equal with all the rest of his children exclusive of the afors’d MARY who is not to be Counted as any part of her advancement or portion but she is to have Mary and a full share besides With all the rest of the Children, and the said WEEKS doth further Covenant and agree and bind himself not to give away, Sell or disperse of any of the aforesaid Negroes in any Way whatever but he is to have the use and hire and benefit of same as long as he lives, the said JAMES WEEKS reserves to himself the power of setting free HIRAM, ALFRED, and ISAAC when they arrive at the age of twenty four if he thinks proper so to do.
