Rodgers; Cheek; Douglass; Robertson; Prewitt; Summers; Lancaster

I Edward D. Rogers of Spencer County in the state of Kentucky do make and 
ordain this my last will & Testament.  I constitute my brother in law Henry 
Cheek my Executor of this my will it is my will and desire that all of my 
Estate be equally divided between John Rogers who lives in Spencer County my 
Brother and Sarah M. Cheek and her bodily heirs of the above County it’s my 
will that my Estate be divided between my brother and aforesaid sister and 
heirs in the following manner.

First it is my will that all of my part of Robert Douglasses Estate which he 
willed to me be divided equally between John Rogers and my sister Sarah M. 
Cheek and heirs before named my guardian Henry Cheek and Executor will account 
to the County Court for as much of my estate as I have received from Thomas 
Robertson who is the Executor of my Grandfather Robert Douglasses Estate is 
three hundred dollars.  I will and desire is that my just Debts and expenses be 
taken out of the three hundred dollars which I have received and the balance 
divided between my sister and brother as before directed.  I will and bequeath 
my interest in a certain negro woman named Marion to my brother and sister 
Sarah M. Cheek and John Rogers.

I also will my Riding horse and forty dollars to my brother in law Henry Cheek 
and one to my brother and sister.

In testimony whereof I hereunto set my hand and seal

The 22nd day of March 1837
Attest I authorize Mr Henry Cheek to set my name & seal

At a County Court held for Spencer County on Monday the 5th day of  June 1837 
This writing purporting to be the last will and testament of Edward D. Rodgers 
deceased was accordingly proved by the oath of Beverly Prewitt one of the 
subscribing witnesses thereto and ordered to be recorded.  And on the motion of 
Henry Cheek the Executor therein named who made oath thereto and together with 
Nicholas Cheek and John Rodgers his securities entered into and acknowledged 
their Bond in the penalty of $2000. Conditioned as the Law directs  Certificate 
is granted him for obtaining a probate of the said will in due form.
