Will Book B p. 180 In the name of God Amen I JOHN SCOTT of the County of Spencer and State of Kentucky being verry sick and weak of body but of perfect mind and memory thanks be given unto God calling unto mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and Testament that is to say principally and first of all I give and recommend my soul into the hands of almighty God that giveth it and my body I recommend to the earth to be burried in decent Christian burial at the direction of my Executors never doubting but at the General resurrection I shall receive the same by the mighty power of God and as touching such worldly Estate where with it hath pleased God to bless me in this life I give and devise and dispose of the same in the following manner and form. I give and bequeath to SARAH my dearly beloved wife the dwelling house together with all the out houses the orchard, field meadow and Twenty acres of cleared Land for and during her natural life and as much timber as may be necessary for firewood and repairs but it is my will and desire that unnecessary waste of timber should not be committed also one third of my negroes and personal Estate during the life of said SARAH. Also I give and bequeath to my sons JOHN and WILLIS one hundred dollars each in current Bank of notes of Kentucky to them and their heirs for ever and it is my wish if it should meet their inclination that the same may be appropriated towards their Education. Also it is my will and desire that after the balance of my Farme after taking out what I have bequeathed as before named to my loving wife SARAH shall be rented and annually at the direction of my Executors herein after named during the life of my wife SARAH and that the money arising therefrom after deducting what may be necessary to keep the same in repair annually and equally divided amongst all my children and at the death of my wife it is my wish that my land be sold for the best price it will bring and the money arising there from to be Equally divided amongst all my children. Also it is my wish that in renting out the balance of my Farme that my Executors should guard against any waste or destruction of Timber. Also I will and desire that the balance of my negroes and personal Estate after the death of my wife SARAH shall be equally divided amongst all my children. Also it is my will and desire that the childs part of my Estate hereby bequeathed to my daughter DELIA HUMPREY be vested in trustees for her support and accommodation . And I do hereby will and bequeath unto BENJAMIN ASHBY, JOSHUA ASHBY and ZACHARIAH ASHBY all the part of my Estate both in money and in property which may be coming to my daughter DELIAH HUMPHREY according to the provisions of this will in Trust never the less that they the said BENJAMIN ASHBY, JOHN and ZACHARIAH ASHBY will hold and exercise the same for the support, maintenance and accommodation of my said daughter DELIA HUMPHEREY during her natural life and at her death to desend to her children and in the event of her dying without children then that the same or what part of my be left be equally divided amongst my children and I further will that if my Estate be liable for a Debt of Fifteen dollars due to Col. DOOM from ELI HUMPHREY and a Deb in commonwealth Bank for which I am his security that then and in that case the amount that my Estate shall then be bound for shall be deducted from my said Daughter DELIA HUMPHREYS part with the addition of one hundred per cent thereon. Also I do hereby Constitute and appoint my Friends JAMES STONE and BENJAMIN ASHBY Executors of this my last will and Testament here by revoking all others or former wills or Testaments by me heretofore made.
