All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ky/kyfiles.html ************************************************ File contributed for use in USGenWeb Archives by: Patricia O'Connor p-oconnor@att.net November 16, 2006, 8:43 pm Source: Spencer County Will Bk B, Pp 324, 325 Written: February 19, 1840 Recorded: July 5, 1841 Transcription: Will of John STRANGE Spencer County Will Bk B, pp 324, 325 STRANGE; SHOEMAKER; HENSON; ROBERTSON; KURTZ; CLARKE; LePAGE; LANCASTER In the name of God Amen I John STRANGE of the county of Spencer in the state of Kentucky being weak in body but of perfect mind and memory, thanks be given unto God calling unto mind the mortality of my body and knowing that it is appointed for all men once to die, do make and ordain this my last will and Testament that is to say principally and first of all I give and recommend my soul unto the hand of Almighty God that gave it and my body I recommend to the eath, to be buried in decent Christian Burial at the discretion of my Executor, nothing doubting but at the general resurrection I shall receive the same by the mighty power of God. And as touching such worldly estate herewith it hath pleased God to bless me in this life I give devise & dispose of the same in the following manner and form. First After the payment of my just debts and funeral expenses I give and bequeath to Jane my Dearly beloved wife my land and negroes and also my personal Estate to be used by her for her support and accommodation during her natural life, none of which is to be wasted or sold or destroyed, but the proceeds thereof is to be applied to the support and accommodation of my said wife for and during her natural life. Second After the death of my said wife Jane I will and bequeath unto my only surviving child and son James STRANGE and to his heirs and assigns forever all of my Estate both real personal and mixed of every kind soever in fee simple to him his heirs and assigns forever and whereas I am about to be compelled to pay a Debt upon a Judgement of the Spencer County Court in favor of John SHOEMAKER against John HENSON and myself as the security of said John HENSON now if I shall be compelled to pay said debt, I will and bequeath unto my son James STRANGE and to his heirs and assigns forever the aforesaid Debt, Interest and costs which will be due and owing from said John HENSON to me in the full power to ____ prosecute and recover the same of and from the said Jo hn HENSON in my name or otherwise as he may think proper. As for my grandchildren Polly HENSON Beaford STRANGE Charles ROBERTSON and Artemissa KURTZ I will and bequeath unto each of them one Dollar each which in addition to what their mother has in her lifetime rec d from me shall be in full of my estate coming to them. And lastly I hereby appoint my son James STRANGE to be sole Executor of this my last will and testament hereby revoking all other and former wills by me in any manner heretofore made. In Testimony whereof I have hereunto set my hand and seal this 19th day of February 1840 Signed sealed published pronounced and dictated by John STRANGE to John [X] STRANGE [seal] be his last will & Testament in presence of us Witness W. P. CLARKE Geo LePAGE At a County Court held for Spencer County on Monday the 5th day of July 1841. This writing purporting to be the last will and Testament of John STRANGE Deceased was proved according to Law by the Oaths of William P. CLARKE and George LePAGE the subscribing witnesses thereto and is ordered to be recorded And on the motion of James STRANGE the Executor therein named who made oath thereto and together with Raphael LANCASTER his security entered into and acknowledged a Bond in the penalty of $1500. conditioned as the Law directs certificate is granted the said James STRANGE for obtaining a probate of the said will in due form.
