Subject: WILL: West, James, 1842, Spencer Co From: "Polly A. Menendez" In the name of God, Amen. I, James West of the County of Spencer, and State of Kentucky, being weak in body but of sound mind and disposing memory wishing to dispose of my estate in the best manner I can, I do hereby make and ordain this as my last will and testament. First, I will and bequeath to my wife Tabitha, after my just debts are paid, all my real and personal estate during her widowhood. (except a reservation herinafter mentioned) but in case she should marry again, then and in that event it is my will that my wife have one third part of my real and personal estate during the remainder of her life and at her death it is my will that all my estate be equally divided among all my children. It is my will that my faithful servant Radford be free in ten years from this time. It is my further will that my wife give to my children as they marry or come of age one negro from eight to fifteen years of age; also a horse, bridle and saddle, one bed and furniture/ It is my will that my wife keep the property and children together as far as she can during her widowhood and in the event of her marrying again the two- thirds of my estate real and personal to be divided equally among my children. I hereby appoint my wife Tabitha my executrix, and do hereby authorize her to make sale of such personal property as she may judge best to pay my debts and to help raise and educate the children. Newman At a county court held for Spencer County on Monday the 6th day of June 1842 this writing purporting to be the last will and testament of James West, deceased, was proved according to law by the oaths of Thomas Newman and Kennon Holt subscribing witnesses thereto and is ordered to be recorded. The said witnesses at the same time deposed that the said writing was executed by the testator on the 22nd day of April 1842, and on motion of Tabitha West the executrix therein named who made oath thereto and together with Beverly Prewitt her security entered into and acknowledged a bond in the penalty of $14000 conditioned as the law directs certificate is granted her for obtaining a probate of the said will in due form. Sullivan, Clerk of the Spencer County court, certify that the foregoing is a true and correct copy of the will of James West as appears of record in my office in Will Book B page 397.
