Submitted by: Jeremy B Johnson Taylor County Will Book 2, Page 12 I Nathan Phillips of Taylor County Kentucky being weak in body but of sound mind and disposing memory do make and publish this my last will and testament hereby revoking all other wills heretofore made by me. Item 1st: I commit my soul to God who gave it and desire my body to be buried in a decent & Christian like manner. Item 2nd: I will and bequeath to my beloved wife Ruth Phillips after the payment of all my just debts and funeral expenses all my propery, both real and personal and mixed during her natural life and widowhood but if she should again marry then she is to have only what the law allows her should I die intestate. Item 3rd: I will & desire that my wife give to James M. Phillips a bed, also to Blandford Phillips a bed and cow and also to Morten Phillips a horse worth seventy five dollars and a bed and cow to make them equal with my first other children who have already received the articles. Item 4th: I will and desire to my son Donaldson Phillips 2/3 of my home place where I now live and one half of all the personal property at the death or second marriage of my wife provided he remains with his mother during her natural life or widowhood and does the part of a dutiful son. Item 5th: I will and desire my son Blandford Phillips to have one hundred dollars for his services since he became of age this devise to be paid by my wife when she can conveniently do so or at her death. Item 6th: I will & desire all the remainder of my realty to be sold at the death of my wife or at her marriage and provided she should again marry and the procceeds equally divided between my children Permelia Wayne, Ann Elliza Dorty, Henrietta Jarboe, Nancy Ellen Hackley, James M. Phillips, Blandford Phillips and David Morten Phillips provided him ever that my wife may if she choose at any time to carry out this 6th item in my will. Item 7th: I will and desire that the two thirds of the home tract devised to my son Nathan Donaldson Phillips be run off as he may desire to include however the six acres bought of Sally E. Asper that my said son have privilege of taking the remaining interest in said home tract at whatsoever two disinterested house keeper to be selected by my said son his brothers and sisters may say it is worth. Item 8th: I will and desire that my wife convey to Robert J. Hackley the land which I have sold to him and for which he holds my title bond as soon as he may pay off the notes which he has executed for said land. Item 9th: I hereby appoint my wife Ruth Phillips executrix of this my last will and testament and empower her to execute by deed or otherwise any conveyance necessary to cary out the same. Chandler State of Kentucky} Sct At a county court commenced and held for Taylor County at the courthouse in Campbellsville on the 4th day of September 1876 the foregoing instrument of writing purporting to be the last will and testament of Nathan Phillips, deceased, was produced into court and proven by the oaths of D. B. Moore and Thomas G. Sharp the subscribing witnesses thereto and after the evidence was heard by the court the same was established as the last true will and testament of Nathan Phillips dec'd and as such was ordered to record Whereupon I have recorded the same and this certificate in my offie this 24th day of October 1876. C. W. Wright, Clerk Note: Nathan Phillips was born May 6, 1816 and died July 7, 1876 in Taylor Co. He was the son of Basil Phillips and Nancy Bailey. Nathan is my (Jeremy Johnson's) 4th great grandfather. He married Rutha P. Eades on September 22, 1837 in Green Co., KY. Rutha was born October 8, 1819 and died September 16, 1902 in Taylor Co. She was the daughter of George C. Eades and Juliette Campbell, and granddaughter of Lawrence Campbell, a Revolutionary War soldier and early tavern keeper in Campbellsville. Nathan and Rutha were the parents of eight known children: 1. Permelia V. Phillips married Ed. M. Wayne 3 February 1862, married 2nd Nathan Trine 5 August 1892 2. Nathan Donaldson Phillips married Lutitia Belle Hoskins 12 September 1878
