Article of agreement made this 23rd day of March 1837 between Leroy Bain of the County of Trimble and State of Kentucky of the first parte and Susanah Giddens widow of James Giddens, dec'd of the second parte whereas the said Susanah is seized to her & to her heirs in fee simple of an a certain tract of land missuages or tenament with their appurtenances situate lying and being in the County of Trimble whereon she now lives and whereas a marriage is shortly intended to be had and solemnize between the said Leroy Bain & the said Susanah and he the said partie of the first parte doath agree with the partie of the 2nd part to release to her all and every part of her property that she now has and neither claim nor contract any parte of it and she the partee of the second part doath hereby convenant and agree with the partee of the first parte in the event of her being the longest liver that she will not claim dower in her estate and that she relinquishes all and every part thereof that she might have in law or equity by virtue of her said marriage except comfortable her support during of henatural life. In witness whereof the parties have hereunto set their hands and seals the day and year first above written sealed and delivered in the presence of W.H. Gatewood, Abner J. Giddens. Leroy Bain, (seal) Susanah Givens (seal) I, James Latty Clerk protempore of the County Court of Trimble in the State of Kentucky, do certify that this marriage contract between Leroy Bain and Susanah Giddens was produced to me in my County and acknowledged by the said Leroy Bain the 5th day of April 1837 to be his act and deed and laid over for proof and the same was on the 28th day of June, proven in part by the oath of W.H. Gatewood one of the subscribing witnesses and on this day proven by the oath of Abner J. Giddens the other subscribing witness to be the act and deed of Leroy Bain and Susanah Giddens and the same together with this certificate hath been duly admitted to record in my office.
