Deed: Benjamin Barnes: Trimble Co: 1838 Submitted by: Joy Mack Email: cmuck@seidata.com Trimble County Courthouse Bedford, Kentucky Deed Book A, pg. 119-120 Dated 23 Apr 1838 Grantor: Benjamin Barnes Grantee: George Strother THIS INDENTURE made this 23rd.day of April eighteen hundred and thirty eight between Benjamin Barnes of the County of Trimble and Commonwealth of Kentucky of the one part, George Strother of the County and Commonwealth aforesaid of the other part Witnesseth: That the said Benjamine Barnes fro and in consideration of fifteen dollars to him in hand paid the receipt whereof is hereby acknowledged hath granted, bargained and sold and by these presents doth grant, bargain and sell unto the said George Strother his heirs and assigns his legacy or one child's part in the land of his father Bengamen Barnes deceased it being the one ninth part of fifty acres be the same more or less and lying and being in Trimble County on the waters of Corn Creek and bounded as follows, towit: Beginning at two beeches and sugar saplins in Cardwell's line and South West corner to Shadrack Barnes land now George Strothers land, thence north seventy six degrees East with said Strothers and Robert J. King's line three hundred and twenty poles to a sugar tree corner to said Kig and in Samuel Underwood's line, thence South fourteen degrees East with said Underwoods line, twenty five poles to a white oak corner to John M. Pritchard, thence South seventy six degrees West with said Pritchards and said Strother line, three hundred and twenty poles to an ash and two walnuts in George Cardwells now George Strothers line, thence with said line North fourteen degrees West twenty five poles to the beginning containing fifty acres be the same more or lesss together with all and singular the appurtenances thereunto belonging or in any wise appertaining. To have and to hold the said land hereby conveyed with the appurtenances unto the said George Strother his heirs and assigns forever. And the said Benjamine Barnes for himself, his heirs, executors and administrators, the aforesaid tract of land and and appurtenances unto the said George Strother his heirs or assigns against the claim or claims of all and every person or persons whatsoever doth and will forever warrent and defend by these presents. In witness whereof the said Benjamine Barnes together with Polly Barnes his wife who hereby relinquishes her right of dower in and to the lands conveyed in this deed hath hereunto set their hands and seals, the day and date first above written. Signed, sealed and delivered in Presence of his Benjamin X Barnes (seal) mark Polly Barnes (seal) I James Latty Clerk protempore of the County Court of Trimble County in the State of Kentucky do hereby certify that this deed from Benjamine Barnes and Polly Barnes his wife to George Strother was this day produced to me in my office by the grantors and acknowledged by the said Benjamine Barnes to be his act and deed.And the said Polly Barnes being examined by me privaly and apart from her husband, declared that she did freely and willingly seal and deliver the said writing and wishes not to retract it, and acknowledged the said writing again shown and explained to her to be her act and deed, and consenteth that the same may be recorded.
