Hoagland THIS INDENTURE made and entered into this 12th day of December 1851 between Abner Bates and Phebe Bates his wife of the County of Trimble and State of Kentucky of the first part and M.F. Hoagland of the County of Carroll and State aforesaid of the second part Witnessth, That for and in consideration of the sum of Forty Dollars in hand paid by the party of the second part the receipt whereof is hereby acknowledged by the party of the first part they have bargained sold and Transfered and by these presents do bargain sell and convey unto the said M.F. Hoagland and his heirs forever. The undivided interest of them tho said Abner and Phebe Bates in and to the following tract or parcel of land. lying and being in Trimble County State of Kentucky and being the same tract of land owned by Henry Wise deceased at the time of his death The said Phebe being one of The Children of said Henry Wise named said Tract of land supposed to contain one hundred and five acres. _____ (led) The same more or less To Have and To Hold The undivided interest of them the said Abner Bates and Phebe his wife in and To this aforesaid tract or parcel of land unto the said Hoagland and his heirs forever and the said Bates & wife hereby convenant and agree with the said Hoagland that they will and their heirs & shall warrant and forever defend the aforesaid undivided interest against the claim or claming of all and every person or persons lawfully Claiming ot To claim same. In Testimony whereof The said parties of the first part have hereunto set their names and affixed their seals the date first written. Hogland was this day produced to me in my Office and asknowledged by the said Bates to be his act and deed and the said Pheby being examined by me privily and apart from her said husband declared that she did freely and willingly seal and deliver said writing and wishes not to retract it and acknowledged said writing again shown and explained To her to be her act and deed and conveanteth that the same might be recorded which is done.
