Young (buyer) THIS INDENTURE made this 9th day of October 1838 between David Gillum and Mary Gillum, his wife, of the County of Trimble & State of Kentucky of the one part and James S. Young of the same place of the other part, Witnesseth: That the said David Gillum & Mary Gillum for and in consideration of sum of four hundred and two dollars & sixty cents to them in hand paid the receipt of which they do hereby acknowledge hath granted, bargained and sold and by these presents doth convey unto the said James L. Young and his heirs forever a certain tract of parcel of land situate, lying and being in the County & State aforesaid on Corn Creek part of John Roberts survey of ten thousand acres surveyed and purchased of David Owen and the same land that we the said David Gillum & Mary Gillum now live on and bounded as follows (Viz:) Beginning at three beeches standing in the dividing line which was made between said Roberts, Ben Pope & James Patton, thence North 76 East 160 poles to two linns & a Beech thence South 14 East 200 poles to a linn, dogwood and ironwood, thence South 25 degrees West 52 poles to two sugar trees on a branch, thence South 60 degrees West 52 poles to a elm & sugar tree in said branch, thence North 87 degress West 72 poles to Elm, sugar tree & ash trees on said branch & said division line, thence with said division line two hundred and forty poles to the beginning containing two hundred & twenty five acres be the same more or less To have and to hold the said tract of two hundred an twenty five acres of land described aforesaid to the said James L. Young and his heirs forever and he the said David Gillum and Mary Gillum covenants that they will warrent and defend the said land with its appurtenances unto, him the said James L. Young and his heirs forever against the claim of all persons whomsoever, with the exception of forty two acres & 27 poles which the said David sold to William Toombs in the year 1831 which will more fully appear by referance to a deed made the 19th of September 1831 by said David Gillum and Mary Gillum to the said William Toombs and of record in the Clerks office of Oldham County Ky. which said tract of land last named of forty two acres & 27 poles is not to be included in this mortgage provided nevertheless that if the said David Gillum & Mary Gillum shall, will & truly pay to the said James L. Young the aforesaid sum of four hundred and two dollars and sixty cents with legal interest from this date and all costs that may accrue on or before the expiration of eighteen month from this date then and in that case the foregoing mortgage shall cease determine and become null and void but in default thereof the same shall stand & remain in full force & virtue in law. In testimony whereof the said David Gillum and Mary Gillum have hereunto set their hands and affixed their seals the day and date first written his David X Gillum (seal) mark her Mary X Gillum (seal) mark I James Latty Clerk protempore of the County Court of Trimble County in the State of Kentucky do certify that this deed of mortgage from David Gillum and his wife, Mary Gillum to James L. Young was this day produced to me in my County and acknowledged by the said David Gillum to be his act and deed, and the said Mary Gillum being examined by me privaly and apart from her husband declared that she did freely and willingly seal and deliver the said writing and wishes not to retract it and acknowledged the said writing again shown and explained to her to be her act and deed and consenteth that the same may be recorded. Whereupon said deed together with this certificate hath been duly admitted to record in my office. Given under my hand this 9th day of October, 1838.
