Colman and Thomas Toombs Grantee: Jefferson Toombs THIS INDENTURE made and entered into this 21th day of December 1863 between Eliza K Colman and Thomas Toombs parties of the first part of the County of Harrison and State of Missouri and Jefferson Toombs of the County of Trimble and State of Kentucky of the second part. Witnesseth that for and in consideration of the Sum of two hundred and thirty dollars for which the Said Jefferson Toombs hath Executed his two notes for one hundered and fifteen dollars each one of the notes is given to Eliza Colman and the other to Thomas Toombs and dated 19th August 1863 and bearing interest from date for which the Said parties of the first part have and by these presents do bargain Sell and convey unto the Said Jefferson Toombs party of the Second part all of their undivided interest in and to a tract of land lying and being in the county of Trimble and State of Kentucky and being the Same on which the father of both parties lived at the time of his death adjoining the lands of T B Young John A Givens & William Barnes containing about one hundred and forty three acres more or less. To have and to hold unto the Said Jefferson Toombs his heirs and assigns forever the undivided interest of the Said parties of the first part in and to the lands above described and the parties of the first part will warrant and forever defend the title of their interest hereby conveyd against the claim of all and every person legally claiming the same a lien is hereby retained until the land is fully paid for. In testimony whereof the Said Eliza K Colman and Thomas Toombs together with his wife Hannah Toombs have hereunto Subscribed their names date first written. Be it remembered that on this 21st day of December AD 1863 before the undersigned Clerk of the county court within and for the county of Harrison aforesaid personally appeared Thomas Toombs and Hannah Toombs his wife and Eliza K Colman who are personally Known to me to be the persons whoes names are Subscribed to the foregoing deed as parties theirto and they acknowledged the same to be their act and deed for the purposes therein contained and She the Said Hannah Toombs being by me first made acquainted with the content of said and on an examination Seperate and apart from her husband acknowledged that She executed the Same and relinquishes her right of Dower in the Real Estate therein mentioned freely and without compulsion or undue influance of her husband.
