Will:Bain: 1841: Trimble Co.: Submitted by: Joy Mack Email: cmuck@seidata.com October 1, 1999 Trimble County Courthouse Bedford, Kentucky Will Book 1 page 78-79 WILL OF LEROY BAIN In the name of God Amen I Leroy Bain of the County of Trimble and State of Kentucky being and in firm but of sound mind and and disposing memory and believing that it is once appointed for all men to die do ordain and appoint and constitute this my last will and testament as follows viz Item first after all my just debts are paid I give to my son Charles Bain one dollar and no more I having mad ample provision for him heretofore. Item 2nd I give to my daughter Susan Law one dollar and no more as I have made ample provision for her previously Item 3rd I give to my daughter Betsy Tanner one dollar and no more having made ample provisions for her previously. Item 4th I give to my grand son James Law six hundred dollars and no more. Item 5th I give to my daughter Polly Ann Giddens one Negro girl by the name of Sarry Ann which she now has in possession and all her increase to her use and the use of her heirs forever. I also give to my said daughter Polly Ann Giddens the farm and appurtenances on which she and her husband Abner Giddens now lives containing about two hundred and thirty or forty acres for her only use and benefit during her natural life and then to the heirs of her body for their only proper use and benefit, said land is of the value of $1000 which with the Negro Women amounts to the sum of $1400. Item 6 I give t my son Thomas J. Bain in addition to what I have allready given him as much of my estate as will make him equal with my daughter Polly Ann Giddeons but to have no part of the land whereon I now live. Item 7t I give to my son William Bain as much of my estate as will make him equal with my daughter Polly Ann Giddeons but to have no part of the land whereon I now live. Item 8th I give to my son John Bain all the tract of land whereon I now live containing about two hundred and fifty acres for his only property use after the portions as aforementioned it is my desire that the said remainder should be equally divided between my four last mentioned children Viz Polly Ann Giddions Thomas J. Bain William Bain and John Bain, and lastly I do hereby constitute and appoint my faithful friend Moses Tandy my executor to this my last will and testament and do hereby revoke all other former wills heretofore made by me and declare this to be my last and only will and testament. Rowlett State of Kentucky Trimble County Court January Term 1841 Moses Tandy who was appointed executor of the estate of Leroy Bain by last will and testament produced in court the will of the said Leroy Bain and moved the court to record the same and then come Charles Bain one of the children of said Leroy Bain and objected to the recording of the same and on his further motion the same is continued until the next term of this court at his costs. att James Latty Clk. State of Kentucky Trimble County Court February term 1841 This day came again Moses Tandy and moved the court to record the will of Leroy Bain dec'd and Charles Bain one of the children of said Bain by his atto moved the court for a continuance and after hearing the argument of counsel the court overruled the motion whereupon Moses Tandy Thomas O Rowlett and Robert B Ryan the subscribing Witnesses to the last will & testament of Leroy Bain being sworn state that the said writing was signed and acknowledged by the said Leroy Bain as and for his last will and testament and that they believe he was of a sound disposing mind and memory at the time of doing the same And the defendant Charles Bain asked leave to withdraw his Objection to the recording of the same to which the plffs by their atto objected and after hering the argument of hte attornies leave is granted him to withdraw his objections and the said will is ordered to be recorded and thereupon Moses Tandy Executor named in said will came into court and took upon himself the burthen of the execution thereof and having taken the oath required by law and entered into bond with Tho.s J.
