Ky ------------------------------------------ Submitted by: Donald King email: King@boing.com ------------------------------------------------ Will of Thomas Hardin I Thomas Hardin of Trimble Co and State of Kentucky Being weak in body but sound in mind and disposing memory, do make and publish this my last will and testament. 1st It is my will that the tract of land on which, I now reside be equally divided between my two sons James Hardin and Charles Hardin the division is to be so made that James Hardin is to have the uper end or half joining McEntire and Mayfields line and is to take possession of his half at my death The lower end or half that I design for my son Charles, my wife is to live on it and have the rents and profits of the same so long as she lives and at her death, my son Charles is then to take possession of his half This tract of land is divised and bequeathed to them and their heirs forever. 2nd I desire that my wife retain and keep in her possession all my stock farming utensils and household and kitchen furrniture during her live and at her death whatever may then be on hand of the above personal mentioned^ property, I wish divided in the following manner (to wit) One bed and furniture One bureau and one good cow to my daughter Amanda Hardin to make them equal with my daughter Charity as she has been advanced that much and therefore the balance to be equally divided between James Charity Charles and Amanda to have and to hold forever. 3rd It is also my will and desire that at my death all of my money which may be on hand and which may be owing to one either by note or account be collected and after all my just debts are all paid Then for the balance to be put out on interest. And the interest arising thereon to be collected and annually given and paid over to my wife for her use and support and to do with as she thinks proper and at her death then for the principal to be collected and devided in the following manner Towit Two dollars to my daughter Judith George Two dollars to my daughter Elizabeth Nichols Two dollars to my daughter Nancy King two Dollars to my daughter Polly Hardin Two dollars to my daughter Kitty Two dollars to my son Thomas Hardin and after the above legacies are taken out of the money then for the ballance to be divided between my three children namely James, Charles and Charity in the following manner, towit, my daughter Charity is to have two hundred and fifty dollars to make her equal with James nd Charles as I have given them the land more than I have given her and the ballance to be equally divided between James, Charity and Charles to have forever 4 In the event of the death of either one of the three children towit James, Charity and Charles before he she or they get pofsefsion of the property above devised to them It is my will and desire that the survivor or survivors of them to have and to take the legacies which the one or two so deceased would have taken had they all lived to take pofsefsion of the same provided either shall die before pofsefsion is taken. 5 Having now mentioned the manner in which I wished my property bo be disposed of I appoint my son James Hardin my sole executor and desire him to see that this my last will and testament is carried into effect And it is my wish and desire that the County Court will not require my executor to give security as all of my property is Specifically devised Amen In Testimony whereof I have here unto set my seal and written my name this 27th day of June 1837 Test Victor Buchanan Thomas Hardin (seal) John Fish Madison Mayfield State of Kentucky Trimble County Court May Term 1842 A writing purporting to be the last will and testament of Thomas Hardin deed, was produced in court whereupon Madison Mayfield and Victor Buchanan Two of the subscribing witnefses being sworn state that said writing was signed and acknowledged by the said Thomas Hardin as his last will and testament that they attested the same at his request & in his presence and that they believe that at the time of doing the same he was of sound mind and disposing memory, which will is ordered to be recorded. which is accordingly done.
