McGinnis and Elizabeth McGinnis his wife of the County of Warren and State of Kentucky of the one part and James H. McGinnis of the County of Boyle and State aforesaid of the other part witnesseth. That the said Jesse S. McGinnis and Elizabeth McGinnis his wife for and in consideration of the sum of Seventeen Hundred & seventy Dollars to them in hand paid by the said James H. McGinnis the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto him the said James H. McGinnis seventy eight acres and [too dark to read] of land lying and being in the County of Boyle and State of Kentucky on the waters of Quirks Run and bounded as follows (towit) Beginning at a corner to B. L. McGinnis in G. Proctors line figur 1 thence south 41 poles to a corner to Wm. McGinnis figur 1 thence N89- 1/2E 140 poles to a stone corner to the same thence South 5 poles to a stone near a sugar tree stump thence N88E 112 poles to a corner to Wm. Owens' thence N1/2W 53 poles to a corner to B. L. McGinnis thence S89-1/2W 178 poles to a corner to the same thence S15-1/2W 10-1/2 poles to a corner to the same thence S89-1/2W 72 poles to the beginning. To have and to hold the said tract of land with its appurtenances to the said James H. McGinnis his heirs and assigns forever and the said Jessee S. McGinnis and Elizabeth McGinnis his wife the said tract of land with its appurtenances unto the said James H. McGinnis his heirs and assigns against the claim or claim of themselves their heirs & and against the claim or claims of all and every person or persons whoever we will warrant and defend forever. In testimony whereof the said Jessee S. McGinnis and Elizabeth McGinnis his wife hath hereunto set their hands and seals the day and year first above written. Jesse S. McGinnis and Elizabeth McGinnis his wife to James H. McGinnis was this day produced to me in my office and acknowledged by the said McGinnis to be his act and deed and the said Elizabeth McGinnis being examined by me privily and apart from her said husband declared that she did freely & willingly seal and deliver said writing and wishes not to retract it and acknowledged the said writing again shown and explained to her to be her act and deed and consenteth that the same may be recorded.
