Deed Bk C, p 92-95 Brown; Cocke; Conner; Hawes; Swelson; Hill This Indenture made this ninth day of June in the Year one thousand eight hundred and four Between Daniel Brown and Betsy his wife of the County of Culpepper and State of Virginia of the one part and Richard Cocke of the County of Washington and State of Kentucky of the other part Witnesseth the said Daniel Brown and Betsey his wife in consideration of the just sum of twenty five hundred dollars lawful money of Virginia to them in hand paid by the said Richard Cocke _______ and _________ of these presents, receipt hereof is acknowledged have bargained and sold unto the said Richard Cocke his heirs and assigns fourteen hundred acres of land lying and being in the County of Washington and State of Kentucky on the waters of Cartrights Creek ____ said fourteen hundred acres of land are included in the Surveys and bounded as followeth. One tract of four hundred acres beginning at a double ash and sugartree on a ridge thence north fifteen degrees ____ two hundred poles to a hickory Locus and sugartree thence north seventy five degrees East three hundred and twenty poles to a stooping black oak sugar and ash trees near a branch thence north fifteen degrees west two hundred poles to a hoop ash and walnut trees on the west side of a hill thence south seventy five degrees west three hundred and twenty poles to the Beginning also one other tract of seven hundred acres beginning at two sugartrees and walnut trees thence east fifteen degrees west three hundred and fifty poles to a white oak and hickory near a Vally thence north seventy five degrees East three hundred and twenty poles to a sugar white oak and mulberry trees thence north fifteen degrees west three hundred and fifty poles to a large white oak and ash trees thence south seventy five degrees West three hundred and twenty poles to the Beginning. Also one other tract of three hundred acres. Beginning at a Locus sugar and ash trees thence south fifteen degrees east one hundred and fifty poles to a white oak sugar and hickory trees north seventy five degrees east three hundred and twenty poles to two sugartrees on the side of a hill thence north fifteen degrees west one hundred and fifty poles to a stooping black oak ash and sugartrees on the east side of a branch that runs into Cartrights Creek thence south seventy five degrees west three hundred and twenty poles to the Beginning to all and singular the appurtenances thereunto belonging TO HAVE AND TO HOLD the said three tracts of land with the tennaments hereditymants and all and singular the premises hereinbefore mentioned or intended to be bargained and sold and every part and parcel thereof with every of their rights members and appurtenances unto the said Richard Cocke his heirs and assigns forever to the only use and behoof of him the said Richard Cocke his heirs and assigns forever and the said Daniel Brown and Betsey his wife do hereby warrant and Defend the aforesaid three tracts of land to the said Richard Cocke his heirs and assigns with all there appurtenance before mentioned against the claim of the aforesaid Daniel Brown and Betsey his wife their heirs and assigns and all and every person or persons Lawfully claiming by through or under them or either of them but not against the claim or claims of any other person or persons whatsoever Witness whereof we the said Daniel Brown and Betsey his wife have hereunto set our hands and seals the day and year above written. Slaughter Le-sa Conner and Aylett Manch Gentlemen Greeting whereas Daniel Brown and Betsey Brown his wife by their certain Indenture of bargain and sale bearing date the _____ day of ______ 1804 have sold and conveyed to Richard Cocke fourteen hundred acres of land being in the County of Washington and State of Kentucky and in three surveys and whereas the said Betsey cannot Conveniently travel to our County Court of Culpepper to make acknowledgement of the said Conveyance therefore we do give unto you or any two or more of you power to receive the acknowledgement which she the said Betsey Brown shall be willing to make before your of the conveyance aforesaid Contained in the said Indenture which is hereunto annexed; and we do therefore Command you that you do personally go to the said Betsey Brown & receive her Acknowledgement of the same and examine her privately and apart from the said Daniel Brown her husband whether she doth the same freely and Voluntarily without his persuasions or threats; and whether she be willing that the same should be recorded in our said ______ Court of _____ aforesaid; and when you have received her acknowledgement; examined her as aforesaid that you distinctly Certify us thereof in our said _____ Court under your seals sending them there the said Indenture and this writ. Witness ____ clerk of our said Court the day of ____ 15 and in the ____ year of the Commonwealth John Jameson Culpepper County towit Persuant to & Commission from the County Courts of Culpepper to us directed me the subscribers went personally to Betsey Brown wife of Daniel Brown and Examined her privately and apart from her said Husband touching her Acknowledgement of the Deed which is hereunto annexed and on such Examination find that she Acknowledgeth the same freely and willingly without the threats or persuasion of her said husband & is willing the same shall be recorded in the County Court of Washington in the State of Kentucky or in any proper or legal manner which may be agreeable to the laws of the said State Certified under our hands and seals this 2nd day of June 1804. Given under my hand as Clerk of the said General Court and under the seal ___ of at Richmond the day and year aforesaid. Wilson Allen Virginia to wit, I do Certify that Wilson Allen is Clerk of the General Court of this State and that all due credit is to be given to his Certificate. Given under my hand the 15th day of June 1804 Richard Parker one of the Judges of the General Court Washington County Sct. I. John Reed Clerk of the County Court for the County aforesaid do hereby Certify that on the day of the date thereof This Indenture was produced to me in my office by Richard Cocke party thereto and with the Commission for the Examination of the ____ thereto annexed and the Certificate of the executive thereof theron endorsed; to ___ wit the several Certificates on the said Indenture indorsed was admitted to Record.
