DEED: Washington Co. KY, Gardner to Roswell, Apr 4, 1842 Deed Book "O" page 417 ---------------------------------------------------------------------- Contributed by Barbara Terhune 30 Apr 2000 ----------------------------------------------------------------------- This Indenture made and Entered Into this 4th day of April 1842 between NELSON GARDNER of the County of Washington and State of Kentucky of the one part and NELSON ROSWELL of the same County and State aforesaid of the other part Witnesseth that for and in consideration of the sum of Six hundred and seven Dollars to the said NELSON GARDNER in hand paid the Receipt whereof is hereby Acknowledged he the said GARDNER has this day Granted bargained & sold and by these presents doth Grant bargain & sell to the said NELSON ROSEL the following tract, Piece or parcel of land lying and being in the County aforesaid and on the waters of Glen Creek being the same land on which I now live and adjoining the lands of James POLLY on the South and William MARTINS land on the East and WALTER E. GARDNER onthe North and George DEAN on the West. To have and hold the aforesaid land to him the said NELSON ROSEL his heirs and assigns forever and I do further grant, bargain and sell to the said Nelson ROSEL the following property To wit: Three head of horses, three cows & two steers & ox cart, three beds, bedsteads & furniture, one bureau, one large chest, two easy ploughs & two set of gears and traces, one table, twelve head of hogs, one large kettle, oven skillet & one pot, one doz. chairs, one yearling calf & one qrindstone & my years crop that now making on the farm to have and to hold the aforesaid land & property to him the said NELSON ROSEL & his heirs and assigns forever and I do further Covenent and bind myself to warrant the Title to the aforesaid land & personal property to him the said NELSON ROSEL against the Claim or Claims of all person or persons whatever neverless upon thefollowing condition that I am justly indebted to the said NELSON ROSEL in the following sum of money Towit: evidenced by notes, one note for five hundred Dollars dated the 2nd day of April 1841 and due the 1st day of March 1842 and also one other note for Seventy five dollars dated the 11th day of August 1841 and due 11 day of February 1842. Now this Indenture Witnesseth that if I will and truly pay off and discharge the aforesaid notes with their Interest & c then this Indenture to be void, Else to Remain in full force _______. his Nelson x Gardner mark STATE OF KENTUCKY Washington County S ct I William B. Booker, Clerk of the County Court for the County aforesaid do certify that on the day of the date hereof this Mortgage from NELSON GARDNER to NELSON ROSEL was produced to me in my office and Acknowledged by the said GARDNER to be his Act and deed and there upon at the Request of the Grantee the same has been duly admited to record in Deed Book "O", Page 417.
