Grantor J. B. Cox and wife Mary Cox. “This Indenture made and entered into this 1st day of December 1840 between Joshua B. Cox & Mary his wife of the County of Wayne and State of Kentucky of the one part and Joseph Roberts of the County of Wayne and State of Kentucky of the other part witnesseth that the said Joshua B. Cox and Mary his wife for and in consideration of the sum of two hundred and eighty dollars to them in hand paid the receipt of which is hereby acknowledged have granted bargained sold & by these presents do convey unto the said Joseph Roberts and his heirs forever their undivided interest and share (being one-half) interest to the two tracts or parcels of land herein mentioned and described which are situate lying and being in the County of Wayne and State also on the South side of Cumberland River and bounded as follows to wit: Beginning on a post oak on a conditional line between George Barnet and Peter Fry running thence S15 W48 poles to two post oaks thence binding on Wm Emersons line S25 E140 poles to a red oak thence with said Emersons line S65 E56 poles to a post oak on James Johnsons line thence N29 E77 poles to a stake Jonhsons corner thence N45 W98 poles to a post oak Norton’s corner thence binding on said line N25 E90 poles to a stake being Nancy Jonsons corner thence to the beginning being the same tract or parcel of land deeded to Wesley Huffaher by Felia Houk on the 3rd day of September 1830 and by Huffaher to the said Joseph Roberts & Joshua B. Cox family on the 27th day of October 1836 of record in Wayne County Court Clerks office to have and to hold the undivided half of said tracts of land and the appertenances unto the said Joseph Roberts his heirs & forever. And the said Joshua B. Cox and Mary his wife for themselves their heirs & do covenant and agree to and with the said Joseph Roberts that they will warrant and for ever defend their undivided interest (being one half as asaid) in and to the said tracts or parcels of land and their appertenances against the claim of themselves and their heirs as well as against the claim or claims of all and every other person or persons whomsoever. In testimony whereof the said Joshua B. Cox & Mary Cox his wife have hereunto subscribed their names and affixed their seal the date above written. Joshua B. Cox and his wife Mary Cox to Joseph Roberts was on the 1st day of December 1840 produced to me in my office by the said grantors and acknowledged before me by the said Joshua B. Cox to be his act and deed and the said Mary Cox being examined by me privily and apart from her husband declared that she did freely and willingly seal and deliver the said writing and wished not to retract it and acknowledged the said writing again shown and explained to her to be her act and deed and consented that the same might be recorded. Whereupon the said deed together with the foregoing certificate has been duly admitted to record in my office given under my hand the 18th day of February 1841.
