Witnesseth that the said Henry Garner & Nancy his wife & Peter Catron & Elizabeth his wife for and in consideration of the sum of Four Hundred Dollars to him in hand paid by the said Felix Hawks before the sealing and delivering of these presents the Receipt of which is hereby acknowledged. Have and by these presents do Grant bargain sell ___ E___ & Confirm unto the said Felix Hawks & his heirs forever one twelfth part of a certain tract or parcel of land situate lying and being in the county and state aforesaid on both sides of Beaver Creek__ below the mouth of the Elk Spring Creek containing fifty acres be the same more or less which said fifty acres of land _ conveyed by Nicholas Loyd Garner & Catron by Deed bearing date the 25th day of November 1811 and is Bounded as follows towit: Beginning at a Black oak thence N 85 E 60 poles to two maple saplings thence S 67 E 80 poles crossing Beaver Creek to a white oak thence N 20 E 48 poles to a Spanish oak thence with Beatys line to Garner s thence N 48 W 80 poles with Garners line to Michael Davis(Dean?) corner thence with Davis(Dean?) S 85 W 136 poles to Davis (Dean?) corner t a stake and dogwood thence with a Conditional line made with John Stephenson Thence S 45 E44 poles to the Beginning To have and to hold the said one twelfth undivided part of the said fifty acres with all its appurtenances being the fifty acres of land which the said Catron, Garner and others ___ to make salt unto him the said Felix Hawks and his heirs forever and the said Henry Garner and Nancy his wife & Peter Catron & Elizabeth his wife for themselves their heirs & do covenant and agree to and with the said Felix Hawks that they will warrant and forever defend the said twelfth undivided parcel of said fifty acres of land with all its appurtenances unto him the said Felix Hawks and his heirs forever against the claim or claims of them the said Henry Garner and Nancy his wife & Peter Catron and Elizabeth his wife and against the claims of all persons claiming by through or under them or any of them. In Testimony whereof the said Henry Garner & Nancy his wife and Peter Catron & Elizabeth his wife have hereunto set their hands and affixed their seals the date first above written. Commonwealth of Kentucky Wayne County Court 2nd Day May 1821 I ____ John Chrisman Clerk of the County court for the county aforesaid do certify that the Deed from Henry Garner & Nancy his wife & Peter Catron & Elizabeth his wife to Felix Hawks was this day proven in ___ in my office by the oath of Henry Long(Young?) one of the subscribing witnesses thereto in his proper person afterwards ___ on the _ day of April 1829 it was further proven before me in my office by the oath of John Francis the other subscribing witness which in his proper person to be the act of and deed of Henry Garner & Nancy his wife & Peter Catron & Elizabeth his wife whereupon the said Deed together with the foregoing certificate hath been duly admitted to Record in my office given under my hand this 25th day of April 1829. Jno Chrisman Additional Comments: NOTE: The date of 25th of April 1829 was hard to read. The year could have been 1839. Henry Garner died in the year 1835 in Hardin Co., TN.
