Francis, Wayne County KY, circa 1820's The deposition of Richard Slavy of Lawful age taken before me E H Cullon a Justice of the peace for wayne county at my house in Monticelllo on the 29 th day of June 1821 to be read as evidence In a suit In Chancery now depending In the Wayne Circuit Court wherein Stephen T. Conn is complaintaint and John Francis is Defendant being first sworn deposeth and saith. 1 Question By the Deft Francis: Did or did not Stephen T Conn Tell you that he was charging me with the Expenses after Martin Beaty Bought my Interest in the well at the mouth of Bear creek on the big south Fork Answer he did 2 Question by same did or did not Gover Barry own one blacksmith Shop now at the well besides the one that did the blacksmith was for the well Answer he did 3 Question by same did you or did you k now of said Gover making of iron in Different Kind of tools such as Logchains Drawing chains pot racks Iron wedges screwaugers chisels axes hoes and a great quanity of county work besides Answer I did 4 Question by same how far did you live from the well at that time Answer not over one mile 5 Question by same was you or was you not frequently there during the time of our working together Answer I was 6 Question by same did you or did you not always see my hands there at work at the well when you was there Answer I saw them there at work Generally 7 Question by same did you or did you not understand that the article when It states that we were to go Equal partners in all Expenses and benefits arising from said well only had reference in succeeding in getting salt water Answer I understood that If ya got salt water that after you should get a sufficiency of salt water that you would be equal In Expences and profits 8 Question by same do you or do you not no that we were General partners In Bringing Goods and Iron to that place Answer you was not 9 Question by same do you or do you not know that It was agreed on that three hands was sufficient to carry on the work of the well on the day that Higginbottom agreed to go with your part Answer It was agreed that three hands was sufficient and Higginbottom said If It was not that he had a hand ready to send at any time 10 Question by same do you or do you not know that and that on that day that Higginbottom agreed to pay the one third of the Expences that had accrued or might have accrued by prosecuting the work at the well Answer He agreed to pay one third part of Expences that had or might occur 11 Question by same Do you or do you not know that Conn kept more hands there than was at work at the well about his own private business Answer he had hands there that was not at work at boring for salt some at one kind of work some at another 12 Question by same do you or do you not know that we or either of us ever agreed to hire Cooks or managers to carry on the business Answer we never did to my knowedge I understood that each one was to Cook for them selves 13 Question by same do you or do you not Know that I followed any other business but for the use of the well Answer I do not know that your hands did 14 Question by same did you or did you not hear said Conn say that he was to furnish iron and steel to make an auger 400 feet long if wanted at his own Expence and blacksmith tools to do our blacksmith work for said well and every piece belonging to said auger Answer I did 15 Question by same did you or did you not see any hands cook their own victuals when you was at the well Answer I did and have eat with them 16 Question by same did or did not Conn Employ you to hunt to Kill wild meat for him If he did whose use was It applied to and who paid you for It. Answer Conn employed me Kill meat and paid me for It himself and applied It to his own use 17th Question by same what amount did you pay Conn for James Royal Answer Twenty Dollars 18th Question by same did or did not Conn carry on Two Blacksmith Shops at the well and had employed Wells to learn Shootman the Blacksmith Trade Answer he carried on two Blacksmiths shops and I understood that he was to Learn Shootman the Blacksmith Trade 19 Question by same did or did not Conn do smith work at the well for his customers in the County Answer he did 20 Question by same was It or was It not the Iron That Conn brought to the well that he worked up for his customers in the County Answer it was 21 Question by same did or did not Conn sell the Iron when made up at the shop for his own use Answer he did pay his own debts with it and it was not applied to the use of the well 22 Question by same have you or have you not heard him say that he made great profit by the shop Answer I have 23 Question by same did or did not said Conn say on the day that Martin Beaty Bought my Interests In said well that he was to pay all your part of the Expences that had been Incured at the said well Answer he did 24th Question by same did or did not Conn get an Interest in said well by agreeing to furnish iron and steel to make and auger 400 feet long Blacksmith tools and all pieces belonging to said auger Answer he did further this deponant saith not Richard Slavy (Transcriber's note: this is signed but I do not beleive it is Richard's signature for it appaears to be the same handwriting that wrote the deposition and that was probaby Edward H Cullon, JP. This would be consistant with our past inabilities to locate any signature by Richard Slavy.)
