All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ky/kyfiles.html ************************************************ File contributed for use in USGenWeb Archives by: Vicki Hutchison vickihutchison@earthlink.net May 23, 2009, 5:48 pm Written: March 17, 1819 Recorded: March 26, 1820 This Indenture made this 16th day of March in the year of our Lord one thousand eight hundred and nineteen between Martin Beaty & Lilbourn L Henderson Merchants trading under the firm of Henderson & Beaty Abingdon Virginia of the one part & William Morgan of the County of Whitley state of Kentucky of the other part Witnesseth that the sd Beaty & Henderson for and in Consideration of the Lawful sum of Four thousand dollars to them in hand pain by the sd William Morgan the receipt where of they do hereby acknowledge hat this day and by these presents sold unto the sd William Morgan and his assigns for ever two tracts or parcels of Land situate lying and being in the sd County of Whitely on Cumberland river containing fifty acres each and bound as followeth the first tract Beginning at a beech on the bank of the river at the upper end of the log botton thereice N30W45 poles to a large rock at the foot of an unacceptable cliff Marked W. M. and a yellow pine thence S60W110poles to a large holly near the foot of sd Clift thence S30E73poles to a sugar tree thence S60E110 poles to a sugar tree & stosse thence N30W2 poles to the Beginning. The second tract begins on a large hooly corner to the above tract running thence S51W110 poles to a hicory & holly thence South 73 poles crossing the river to a beech and maple thence N82E138 poles to a sugar tree thence N30W73 poles crossing the river to the Beginning containing in both tracts one hundred acres to have and to hold the sd two tracts or one hundred acres of land to him the sd William Morgan his heirs and assigns to the sole use benefit and behoof of him the sd William Morgan his heirs and assigns and the said Beaty & Henderson for themselves and their heirs doth covenant too and with the said William Morgan and his heirs the said tract or one hundred acres of Land together with the appurtenances privileges and emoluments arising there from to him the said William Morgan his heirs & assigns and the sd Beaty and Henderson for themselves and their doth further covenant and agree to and with the sd William Morgan & his heirs to warent and defend the sd one hundred acres of Land against the claim or claims of them the sd Beaty & Henderson their heirs and assigns forever. In witness where of the sd Beaty and Henderson by Martin Beaty the acting partner of the firm have here unto set their names and affixed their seals the day and year first above written Beaty & Henderson {seal} Acknowledge in presents of State of Kentucky } Knox County Sct. } I doe here by certify that the foregoing Indenture of Bargain and sale from Beaty & Henderson to William Morgan was acknowledged before me by the said Martin Beaty for himself and the said Lilbourn B Henderson to be their act and deed and the same is hereby certified to the clerk of the County Court of Whitely where the land lies given under my hand as Deputy Clerk of the County Court of Knox aforesaid this 17th day of March 1819.
